Permit Changes and Renewals 2. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas greater than 50 linear feet from the tidal wetland boundary.- 6 . All fill shall consist of "clean" sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debris) . 7 . All peripheral berms, cofferdams, rock revetments, seawalls, gabions, bulkheads etc. shall be completed Pzior to placement of any fill material behind such structures . 8 . Bulkhead constructed directly adjacent to vegetated tidal wetlands . shall be jetted in with no disturbance to the tidal wetland. 9 . No clearing other than than necessary for construction of the retaining wall shall be done without further Department approval . 10 . No more than 100 feet of trenching may be excavated at any one time. 11 . Staked haybalas shall be placed . at the seaward edge of the trenches for retaining wall installation, at commencement of regulated activities and remain in place until project is completed .and all disturbed areas stabilized with vegetation. 12 . The permittee shall. incorporate the following language as a notice covenant to the deed: "Regulated tidal wetlands 'associated with Mill Creek are located at Main Road, Southold, County Tax Map Number: District 1000, Section 56, Block 06-, Lot 8 .2, 8 .4, 8, 9 . 1 otherwise known as the properties of Helen Reiter and her heirs, assigns, or successors . This property is subject to the provisions of New York State Environmental Conservation Law (ECL) Article 25 or its successor, and the conduct of regulated activities may occur only pursuant to ECL Article 25 if prior approval is given by the New York State Department of Environmental Conservation (NYSDEC) or its successor. Regulated activities include, but are not limited to the erection of any structure (s) ; ._excavation; dredging grading and filling; clearing of vegetation; and application of chemicals. " This deed covenant shall be recorded with the Clerk of Suffolk County within 90 days of the issuance of this permit. A copy of the covenanted deed or other acceptable proof of record, along with the number assigned to this permit, shall be sent within one calendar year of the issuance of this permit to: NYSDEC, Regional Manager, Bureau of Marine Habitat Protection, SUNY' Building 40, Stony Brook, New York 11790-2356 . The permittee shall require that any contractor, project engineer, or other person responsible for the. overall supervision of this project reads, understands, and complies with this permit and- alla. its general, special, and supplementary special conditions. Any failure to comply precisel conditions of this permit y with all of the terms and , unless authorized in writing, shall be treated as a violation of the Environmental Conservation Law. If any of the permit conditions are unclear, the permittee shall contact the Division of Regulatory Affairs at the address on page one or telephone (516) 444-0365. C. If project design modifications become necessary Permit issuance, the permittee shall submit theafter appropriate plan changes for approval by the Regional Permit Administrator prior to undertaking any such modifications. The permittee is advised that substantial modification may require submission of a new application for permit. D. - At least 48 hours prior to commencement of the the permittee and contractor shall sign and retProject, urn the top portion of the enclosed notification form certifying that they are fully aware of and understand all terms and conditions of this permit. Within 30 days of completion of the permitted work, the bottom portion of that form shall also be signed and returned, along with photographs of the completed work and, if ' required, a survey. E. For projects involving activities to be undertaken in phases over a period of more than one year, the permittee shall notify the Regional Permit Administrator in writing at least 48 hours prior to recommencing work in subsequent years. F. The granting of this permit does rot relieve the permittee of the responsibility of obtaining a grant, easement, or other necessary approval from the Division of Land Utilization, Office of General Services, Tower Building, Empires State Plaza, Albany, NY 1224,2 (516) 474-2195, which may be required for any encroachment upon State-owned lands underwater. Planner _ Re: SCTM#1000-56-6-8.2, 8.7 (formerly 8.5) and 9.2 I$EP 2 2Q,92 Reiter Property gyp, ,U`1r_�,,-� Dear Mr. Hughes: Our company, as agents for the Reiter family, has recently begun undertaking the installation of the ending balance of a 1300+ foot retaining wall at the above referenced property so as to stop the inundation of debris and to define a specific line separating the wetlands from the upland property as dictated by the NYSDEC and the Southold Town Trustees. We were issued a Cease and Desist order by the Southold Town Code Enforcement Director in which he states a violation of Chapter 97 Article H Section 97-20A of the Southold Town Code had occurred whereas,Helen Reiter, who has recently deceased, is presently not the legal property owner. Her three children, Carol Denson, Carl D. Reiter and Joan Cochran are now the legal joint owners of the property. On the belief that the permit ran with the land and Helen and her children desired that the retaining wall be completed prior to the expiration of their permit we have continued to complete the work at the site. A request has been made to the Trustees to change the ownership name on their permit#406 & #459 to that of Helen's children. After a brief discussion with the Code Enforcement Director I was told that a site plan approval may be necessary based on Southold Town's Code under Chapter 100-259 and that I should make an application for determination to the Town's Planning Board. I would like to know whether or not a site plan is indeed necessary where over the last 20 years I have removed Phragmites and saplings, all smaller than 6"in caliber several times. Presently, there is no intention of defining or constructing any of the upland improvements.
