Box 728 Southold, New York 11971 March 4, 1983 Mr. Roy Haje En-Consultants, Inc. 64 North Main Street Southampton, New York 11968 Re: Bulkhead Fee Dear NIr„ Ha j e, One of the problems we have in Southold Town is public access along the shores of our creeks and bays. In the past people who own water front property put bulkheads in town waters and therefore inhibit the public access along the creek- front. To prevent this abuse of public land, a fee was attached to any bulkhead touching or in town waters in hopes that in the future bulkheads would be put above high water mark so that people could travel in front of them. With reference to the Fairlie bulkhead, the Trustees visited the Fairlee site on January 27, 1983, and found the creek waters up to the bulkhead. The Fairlie deed reads as follows: "Running thence in a southwesterly direction along the high water mark of Jockey Creek. " With the above in mind you might suggest to Mr. Fairlie that he have a current survey made of his southwesterly bound- ary along the creek to determine whether the bulkhead is- or is not in town waters. This is the only way that the question you raise can be solved. Yours very truly, Board of Town Trustees 3 , s WA ORWAY: JOCKEY CREEK EN-CONSULTANTS, INC. - 283-6360 A/8 - Rev. 8/72. FRONT STREET AT MAIN (' GREENPORT, NEW YORK 11944 f PHONE 477-0170 April 19, 1983 Mr. Paul Stoutenburgh, President Southold Town Board of Trustees Southold, BY 11971 Dear Mr. Stoutenburgh: Mr. Robert K. Fairlie, Jr. has -relayed to us your re- quest for a letter of determination in regard to his bulk- head and its relation to Town waters. The distance from Wells Avenue to Jockey Creek along the line between Lots 3 and 4 on the filed map of '"George H. Wells" (Suffolk County No. 859) was 205 feet; the line between Lots 2 and 3 was 223 feet. Our first survey of the Fairlie parcel was done in 1968 and was then owned by W. Corey and Elizabeth T. Albert- son (see two prints enclosed) . The distance along the line between lots 3 and 4. to ordinary high water at the bulkhead was 201 feet, four feet back from the filed map distance. The distance to the bulkhead along the line between Lots 2 and 3 was approximately 193 feet, 30 feet back from the filed map distance. The following are unknown to me: ( 1 ) The location of the existing ordinary high water mark at the time the bulk- head was constructed; (2) The ownership of the land under water between ( 1 ) and ordinary high water mark per filed map; (3) The date the bulkhead was built. I hope the above and the enclosed prints will help in your determination of Mr. Fairlie 's application. Sincerely, RODERICK VAN TUYL, P.C. CVT/avt Colin Van. Tuyl Enclosures (2) cc: Robert K. Town of Southold 0 0 Main Road Southold, New York 11971 Re: Bulkhead 'permit 'for Robert Fairlie. Dear Mr. Stoutenburgh.: I have received your "noti.ce of action" approving the bulk.- head replacement with. th.e. provi.so that the old one. be. remove.d and the new- one. placed in the. same locati.on., in addition, you request a $240.. application fee. It is my understanding that appli.cati.on fees are. assess,ab.le. only when private. work i.s being done. on Town property.. The*. *proposed bulk:- head will be. constructed entirely upon. Mr. and Mrs:.. Fai.rli.e.` s private.ly-owned property. In. s-upport of this contention., I. enclose. a copy of th.e. deed for the subject property and a photocopy of the. survey. Please. review these. documents whi.ch. should convince you that no fee is due.. I would also like to take this opportunity to request that the Board review- its fee schedule.. At $3;.' per foot, the. Southold Trustees fee i.s- by far the highest on Long Island.. In comparison, the Southampton Trustees charge $ . 10 per foot wi.th. minimum fee. of $10. Other entities , including the NYSDEC and the_ Corps of En gi.neers , charge either by a set rate or similar schedule but none. Mr. Paul Stoutenburgh page. 2 Southold Town Board of Trus:te.e.s.
