The said Fisherman.'.s Beach.Associaito4s part of the consideration for the issuance of this permit does hereby release the ,said Board of Trustees and the Town of Southold from any and all damages claims for damages or suits that may arise -or occur directly or indirectly 'as a result of any .operation carried on un- der and pursuant to this permit, and will at his own expense, defend any and all suits which may be brought by third parties, as a result -of any operation carried on pursuant to or in accordance with the terms of this permit, and assume full liability with respect thereto to the complete exclusion of said Board of Trustees and the Town of Southold. THIS PERMIT is subject to the following terms and conditions: 1. That there shall be no unreasonable interference with navigation as a result of the work herein authorized. 2. That there shall be no interference with the right of the public to pass and re- pass along that portion of the beach between low and high water mark. 3. That the work shall be subject to the supervision and approval of the said Board of Trustees or its agents. 4. That if future operations of the Town of Southold require the removal and/,or alteration in the location of the work herein authorized, or if, in the opinion of the Board -of Trustees of the Town of Southold, such work shall. cause un- reasonable obstruction to free navigation, the said Fir.-herm4W.S .Beach,Assoc. will be required upon due notice from the said Board of Trustees, to remove or alter the location of the work hereby authorized without expense to the Town of ,Southold, so as to render navigation reasonably free and unobstruct- ed. This application to be completely filled in by typewriter or in ink and submitted to the Town Trustees in dup- licate. B. Plot plan showing location of lot and buildings on premises, relation to adjoining premises, public streets, parks, etc., and giving detailed description of proposed layout of project must be drawn on diagram which is part of this application. C. The work covered by this application may not be commenced before the issuance of a permit. D. Upon approval of this application, Town Trustees will issue a permit to applicant. Such permit shall be kept on the premises and available for inspection at all times. E. Applicant shall notify the Board of Trustees upon completion of the work covered by permit. APPLICATION IS HEREBY MADE to the Board of Trustees of the Town of Southold, Suffolk County, New York, for the issuance of a permit pursuant to the laws, Ordinances and regulations governing construction of: docks, piers, bulkheads, jettys and dredging in, under, and over the wafters of Town of Southold. Dear Dr. Samuels; At the meeting of the Southold Town Trustees held on Monday, September 8, 1969, the Trustees examined the application of Fisherman6 Beach Association to dredge in the main channel, Broadwaters Creek. The Trustees request that you indicate on the enclosed application the area where the excavated 300 yards of fill is to be placed. An envelope is enclosed for your convenience. The Trustees were satisfied with the explanation I gave them as to what you had done at Fisherman's Beach and trust that you will follow through on whatever is necessary. Prior to the County dredging of the general area V in 1965, the existing channel ran along the entire creek length of Fisherman's Beach which kept the water clean and the northwest tip of the channel ,. open to boating. ' 'However, with the County dredging the channel line was changed to run directly north up into the Mud Creek area with a spur eastward toward the Nassau Point causeway., running el to Mason Drive see i Y, g parallel ( copy of map attached). :- As a result, the former channel behind Fisherman's f Beach is gradually filling in, the water is becoming + '; •�. sluggish and dirty and at lowtide, it is impossible �r to get any except the smallest boats around the northwest tip of the Beach. W35 e The Southold Town Board 4 Page 2 To alleviate the situation, we propose dredging a channel approximately 30 feet wide and 6 feet deep at mean low water from the County established North . South channel between Fisherman's Beach and Fleet's Ne¢k, behind lot 18 and •approximately 2 of lot 19 to existing deep water behind the other 2 of lot lq. The proposed new channel would be approximately 30 feet off the existing shore line of lot 18 curving in to approximately 10 feet off the shore line at the middle of lot 19, to pick up the existing deep water. We propose depositing the fill in a natural ll gulley running through lot 18 as well as filling in j erosion around existing jetties at the end of the a 'Beach. See copy of survey attached. � II !Our share of the, cost of the dredging would be borne `. by various people affected along Fisherman's Beach.
