The permitted site or facility, including relevant.records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. Permit Changes and Renewals 2. The Department reserves the right to modify, suspend or revoke this permit when: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations is found; b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d) environmental conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. 3. The permittee must submit a separate written application to the Department for renewal, modifica- tion or transfer of this permit. Such application must include any forms, fees or supplemental infor- mation the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. 4. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities(HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and b) 30 days before expiration of all other permit types. 5. Unless expressly provided for by the Department, issuance of this permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, con- ditions or requirements contained in such order or determination. Other Legal Obligations of Permittee 6. The permittee has accepted expressly, by the execution of the application,the full legal responsibili- ty for all damages, direct or indirect, of whatever nature and by whomever suffered, arising out of the project described in this permit and has agreed to indemnify and save harmless the State from suits, actions, damages and costs of every name and description resulting from this project. 7. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impair- ment of any rights, title,or interest in real or personal property held or vested in a person not a party to the permit. 8. Trapped sediments shall be removed to an approved upland site before the bales themselves are.removed. Silt screen fencing is also acceptable. 7. Any debris , excess construction materials, or excess excavated materials shall be immediately and completely disposed of on an approved upland site more than 100 feet landward of any regulated wetland or waterbody. The materials in question shall be suitably stabilized so that they cannot re-enter any regulated water body, wetland, or wetland adjacent area. 8. All fill shall consist of soil, sand and/or gravel that is free of the following sub=. stances: asphalt, slag, flyash, broken concrete, demolition debris, garbage, house- hold refuse, tires, woody materials including tree debris, metal objects. Intro= duction of materials toxic to aquatic life is expressly prohibited. 9. All roof runoff shall be directed to drywells located on the southwest side of the new maintenance building. 10. All areas of soil disturbance resulting from this project shall be seeded with an appropriate perennial grass and mulched with straw immediately upon completion of the project, within two days of final grading, or by the expiration of the permit, which- ever is first. Mulch shall be maintained untila suitable vegetative cover is established. If seeding is impracticable due to the time of year, a temporary mulch shall be applied and final seeding shall be performed as soon as weather conditions favor germination and growth. 11. Irrigation well pumpage is limited to less than 45 gallons per minute. Pumpage of 45 gpm or more will require a NYSDEC Long Island Wells permit. The following are the revisions which have been made: 1 . In the northeast and northwest sections of the proposed silt fencing the fencing has been relocated approximately 5' to limit the disturbed area so that there shall be no disturbance to that area located within 75' of the freshwater wetlands boundary as flagged by the staff of the 2. The regraded area located at the northeast corner of the proposed building has been revised to show that there shall be no filling within 75' of the limits of the wetlands. To do this we have relocated the toe of the fill approximately 5' . ' 3. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental. analysis. In addition, many who have knowledge in one particular area may not be aware of the broader concerns affecting. the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature,yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site.
