Dear Mr. Neilson:
Confirming our conversation this date, some of the applications
you recently referred to this office for wetland permits as
"grandfathered" structures' are presently beyond the
jurisdiction of the Southold Town Trustees under the Town
wetland ordinance. Generally, the only tidal wetland areas
considered jursidictional on Fishers Island are those of West
and Hay Harbors. All open sound areas and
unprotected/non-vegetated coves are considered
non-jurisdictional. Shortly, when the "Sound" areas are
returned to the wetlands ordinance and we implement the recently
approved Town Coastal Erosion Hazard Act the owners may wish to
grandfather their structures.
In Summary:
Christopher Roosevelt - Non-jurisdiction on "Sound"
Lucille Balcom - Non-jurisdiction on "Sound"
Fishers Island Ferry District - Non-jurisdiction as greater than
5" below mean low water.
The $100. 00 fees received for the Balcom and Roosevelt
applications will cover the field inspection for all three
applications.
I hope this answers some of your questions. Enclosed for your
information is a copy of the Town Wetland Ordinance, Chapter 97.

Re: Fishers Island Ferry Dredging
Off-loading Site Modification
Dear Mr. Bredemeyer:
This letter is to notify you of the project status of the maintenance
dredging of the channel into the Fishers Island terminal at Silver Eel Cove on
Fishers Island and the new off-loading site for the disposal of dredged
materials.
The project has been advertised and a low bidder determined. The low
bidder has suggested that the east end of the wood timber pier be utilized for
off-loading since it will be more accessible, and therefore more efficient,
cleaner and less costly. Accordingly it is anticipated that this site will be
used; attached you will find a copy of the plan for this site and the sediment
controls which will be used during off-loading.
We are providing simultaneous notification to the NYS DEC and the Corps of
Engineers of this proposal; I have already spoken with Mr. Chuck Hamilton, of
the DEC Marine Habitat Protection Section, and he had no objection to the
proposal. Please let me know if the need for any further discussion arises.

A detailed description and plans of the applicant's activity are
enclosed to assist in your review.
The decision whether to issu4 a permit will be based on an evaluation
of the probable impact, including cumulative impacts, of the activity
on the public interest. That decision will reflect the national
concern for both. protection and utilization of important resources.
The benefits which reasonably may be expected to accrue from the
activity must be balanced against its reasonably foreseeable
detriments. All factors which may be relevant to the. activity will be
considered including the cumulative effects thereof; among those are
conservation, economics, aesthetics, general environmental concerns,
wetlands, cultural values, land use, navigation, shoreline erosion and
accretion, recreation, water `;supply and conservation, water quality,
energy needs, safety, food production and, in general, the needs and
welfare of the people.
The Corps of Engineers is soliciting comments from the public; Federal,
state, and local agencies and officials; Indian Tribes; and other
interested parties in order to consider and evaluate the impacts of
this proposed activity. Any comments received will be considered by
the Corps of Engineers to determine whether to issue, modify, condition
or deny a permit for this proposal. To make this decision, comments
are used to assess impacts on endangered species, historic properties,
water quality, general environmental effects and the other public
interest factors listed above. Comments are used in the preparation of
an Environmental Assessment and/or an Environmental Impact Statement
pursuant .to the 'NAtional Environmental Policy Act (NEPA) . Comments are
also used to. determine the need for a.public hearing and to determine
the overall public- interest of the proposed activity.
ALL COMMENTS REGARDING THE PERMIT APPLICATION MUST BE PREPARED IN
WRITING AND MAILED TO REACH THIS OFFICE BEFORE THE EXPIRATION DATE OF
THIS NOTICE, otherwise, it will be presumed that there are 'no
objections to the activity.
Any person may request, in writing, before this public notice expires,
that a public hearing be held to collect information necessary to
consider this application. Requests for public hearings shall state,
with particularity, the reasons why a public hearing should be held.
It should be noted that information submitted by mail is considered
just as carefully in the permit decision process and bears the same
weight as that furnished at a public hearing.
Pursuant to Section 7 of the Endangered Species Act (16 U.S.C. 1531)
and based upon . a review of the latest published version of the
threatened and endangered species listing, a preliminary determination
is. that the activity under consideration will not affect those species
listed.;ok their critical habitat.
Based upon a review of the latest published version of the National
Register of Historic Places, there are no known sites eligible for, or
included in, the Register within the permit area. Presently unknown
archaeological, scientific, prehistorical or historical data may be
lost by work accomplished under the required permit.
Reviews of activities pursuant to Section 404 of the Clean Water Act
will include application of the guidelines promulgated by the
Administrator, U.S. Environmental Protection Agency, under authority of
Section 404 (b) of the Clean Water Act and the applicant will obtain a
water quality certificate or waiver from the appropriate state agency
in accordance with Section 401 of the Clean Water Act prior to a permit
decision.
Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972
as amended [16 U.S.C. 1456(c) ] , for activities under consideration that
are located within the coastal zone of a state which has a federally
approved coastal zone management program, the applicant has certified
in the permit application that the activity complies with, and will be
conducted in a manner that is consistent with, the approved state
coastal zone management program. By this public notice, we are
requesting the state's concurrence with, objection to, or waiver of the
applicant's certification. No permit decision will be made until one
of these actions occur. For activities within the coastal zone of New
York State, the applicant's certification and accompanying information
is available from the Consistency Coordinator, New York State
Department of State, Division of Coastal Resources and Waterfront
Revitalization, Coastal Zone Management Program, 162 Washington Avenue,
Albany, New York 12231, Telephone (518) 474-3642. Comments regarding
the applicant's certification should be so addressed.
In addition to any required water quality certificate and coastal zone
management program concurrence, the applicant has obtained or requested

WORK DESCRIPTION
The applicant, Fishers' Island Ferry. District, has requested Department
of the Army authorization to maintenance dredge with upland, disposal, in'
Block Island Sound, at Town of Southold, Suffolk County, New York.
The applicant proposes to dredge 3,500 cubic yards from an area
approximately 30,000 square feet, to a depth of 13 feet below mean low
water. The dredged material would be disposed of at an upland
location. All proposed work would be performed as shown in the
attached drawings. No additional dredging events are anticipated for
the 10-year life of the permit.
The stated purpose for the project is to restore the previously
existing depth in order to provide adequate navigation depth for the
applicant's vessel operations.

Maintenance Dredging: Dredge approximately 3,500 CY of fine sand, over an area of approxi-
mately 30,000 SF, for upland disposal.
".PURPOSE
This project is intended to restore the existing channel to its previous design depth of
13 feet at mean low water. The channel' is subject to being filled with sands acreting from
the prevailing longshore' drift (sediment transport) along the west end of Fishers Island.
Ac.DISCHARGE OF DREDGED OR FILL MATERIAL
There are several upland disposal alternatives including general. fill for construction and
capping the Fishers Island sanitary land fill, pending a determination of material suitability
'by the New York State Department of Environmental Conservation (see attached letter to Mr.
Jerry Bresner, dated 9/6/91 ) . Beach nourishment would be undesirable since the sea conditions
would likely erode the replenished area and re-enter the materials in the sediment transport
system around the island, possibly expediting the need for future maintenance dredging.

Landfill Capping Materials
Dear Mr. Bresner:
I appreciated the opportunity to speak with you regarding the use of
dredged materials for capping the existing landfill at Fishers Island. I
understand that there may be some circumstances which make implementation of
this proposal complex, however', in view of the overall good of the public, and
on behalf .of the Fishers Island; Ferry District, I respectfully request that you
approve the concept, subject to whatever stipulations are necessary to assure
conformance with State regulations. Please consider the following:
-The channel into Silver Eel Pond must be dredged of acreting sand soon in
order to allow continued access by the Fishers Island Ferry. Approximately
3,500 CY of sand is to be removed. The sand is uniformly fine grained, clean,
lacking appreciable organics and, after two weeks of storage at the lab,
emmersed samples emit only a relatively slight oder; dry portions of the sample
were basically oderless. In view of the location of the acreting bar, being in
a high energy environment due to waves, currents and propeller turbulence,
these characteristics are to be expected.
-It is our understanding' that capping material and a capping plan is
needed for the daily operations of the landfill and, although the anticipated
volume would only cover an acre or so, this material could come at a premium if
other (including off_island) sources must be relied on.
-I have spoken with the Fishers Island Conservancy and they support the
proposed project, so long as bulk sediment and leaching characteristics are
within prescribed guidelines, a concern which we all share.
-There are options to this proposal, however it is felt that this is the
most beneficial alternative. To use the sand as beach nourishment may render it
susceptable to being redeposited in the channel, and if no other options are
available, the Connecticut DEP may allow its disposal at the New London Dumping
Grounds to no ones real benefit.
I feel that this is an opportunity for many to benifit from a job which
must be done anyway and might otherwise be less productive. Your favorable
consideration is respectfully requested.

dolphins and ferry racks,' and install and maintainta total of 21 new dolphins.
Dredge the entrance channel to a depth of 131 below mean low water. The area
to be dredged is approximately 300' long and varies in width from 70' to 90'.
The dredged material, approximately 1,200 c.y. of sand and gravel, will be
disposed of at an inland site above the mean high water line.

in and made a part of this permit,, entitled: (See Page 6, Paragraph III).
Subject to the following conditions:
I. General conditions:
a. That all activities identified and authorized herein shall be consistent with
the terms and conditions of this permit; and that any activities not specifically-
identified and authorized herein shall constitute a violation of the terms .and con-
ditions of this permit which may result in the modification, suspension or revoca-
tion of this permit, in whole or in part, as set forth more specifically in General
Conditions j or k hereto, and in the institution of such legal proceedings as the
United States Government may consider appropriate, whether or not this permit
has been previously modified, suspended or revoked in whole or in part.
b. That all activities authorized herein shall, if they involve a discharge or
deposit into navigable waters of ocean waters, be at all times consistent with
applicable water quality standards, effluent limitations and standards of per-
formance, prohibitions, and pretreatment standards established pursuant to
Sections 301, 302, 306, and 307 of the Federal Water Pollution Control Act of
1972 (P. L. 92-500; 86 Stat. 816), or pursuant to. applicable State and local law.
c. That when the activity authorized herein involves a discharge or deposit
of dredged or fill material into navigable waters, the authorized activity shall,
if applicable water quality standards are revised or modified during the term of
this permit, be modified, if necessary, to conform with such revised or modified
water quality standards within 6 months of the effective date of any revision or
modification of water quality standards, ar as directed by an implementation plan
con�ained in such revised or modified standards, or within such longer period of
time as the Division Engineer, in consultation with the Regional Administrator of
the Environmental Protection Agency, may determine ,to be reasonable under the
circumstances.

f. That the permittee shall permit the: Division Engineer or his authorized
representative (s) or designee (s) to make periodic inspections at any time cic•c•mec
necessary in order to assure that the activity being performed under authority of
this permit is in accordance with the terms and conditions prescribed herein.
g. That the permittee shall maintain the structure or work authorized herein
in good condition and in accordance with the plans and drawings attached hereto.
h. That this permit does not convey any property rights, either in real estate
or material, or any exclusive privileges; and that it does not authorize ar,,- r.iur•;
to property or invasion of rights or any infringement of Federal, State, Cr locz:l
laws or regulations, nor does it obviate the requirement to obtain State or local
assent required by law for the activity authorized herein.
i. That this permit does not authorize the interference with any existing or
proposed Federal project and that the permittee shall not be entitled to compen-
sation for damage or injury to the structures or work authorized herein which
may be caused by or result from existing or future operations undertaken by the
United States in the public interest.
j. That this permit may be summarily suspended, in whole or in part, upon
a finding by the Division Engineer that immediate suspension of the activity
authorized herein would be in the general public interest. Such suspension shall
be effective upon receipt by the permittee of a written notice thereof -which shall
indicate (1) the extent of the suspension, (2) the reasons for this action, and (3)
any corrective or preventative measures to be taken by the -permittee which are
deemed necessary by the Division Engineer to abate imminent hazards to the
general public interest. The permittee shall take immediate action to cornDIX• Xvitl
the provisions of this notice. Within ten days following receipt of this notice of
suspension, the permittee may request a :hearing in order to present information
relevant to a decision as to whether his permit should be reinstated, modified
or revoked. If a hearing is requested, it shall be conducted pursuant .to proce-
dures prescribed by the Chief of Engineers. After completion of the hearing,
or within a reasonable time after issuance of the suspension notice to the permit-
tee if no hearing is requested, the permit will either be reinstated, modified or
revoked.

k. That this permit may be either modified, suspended or revol-ed in who�ic•

mines that there has been' a violation of any of the terms or conditions of this
permit or that such action would otherwise be in the public interest. Any tiuch
modification, suspension,, or revocation shall become effective 30 days after,
receipt by the permittee of written notice of such action which shall specify
the facts or conduct warranting same unless (1) within the 30-day period the
permittee is able to satisfactorily demonstrate that (a) the alleged violation
of the terms and the conditions of this permit did not, in fact, occur or (b) the
alleged violation was accidental, and the permittee has been operating in com-
pliance with the terms and conditions of the permit and is able to provide satis-
factory assurances that future operations shall be in full compliance with the
terms and conditions of this permit; or (2) within the aforesaid 30-day period,
the permittee requests that a public hearing be'.held to present oral and written
evidence concerning the proposed modification, suspension or revocation. The
conduct of this hearing and the procedures for making a final decision either to
modify, suspend or revoke this permit in whole or in part shall be pursuant to
procedures prescribed by the Chief of Engineers.
1. That in issuing this; permit, the Government has relied on the information
and data which the permittee has provided in connection with his permit applica-
tion. If subsequent to the; issuance of this permit, such information and data prove
to be false, incomplete or inaccurate, this permit may be modified, suspended or
revoked, in whole or in part, and/or the Government may, in addition, institute
appropriate legal proceedings.
M. That any modification, suspension, or revocation of this permit shall not
be the basis for any claim for damages against the United States.
n. That the permittee' shall notify the Division Engineer at what time the
activity authorized herein will be commenced, as far in advance of the time of --
commencement as the Division Engineer may specify, and of any sus pens ion ;f
work, if for a period of more than one week, resumption of work and its coYn-
pletion.
o. That if the activity authorized herein is not stafted on or before
day of 19 _ and is' not completed on o$r before
3 day 19 7q this permit, if not
previously revoked or specifically extended., shall automatically expire.
p. That no attempt shall be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the activity authorized
by this permit.

y. That, if -the display of light:; and signals on any structure or wort.
,�. authorized herein is not otherwise provided for by law, such lights and
signals as, may be prescribed by the United States Coast Guard shall be
installed and maintained by and at the expense of the permittee.
r. That this permit does not authorize on approve the construction
of particular structures', the authorization or appoval of which may re-
quire authorization by the Congress or other agencies of the Federal
Government.
s. That if and when the permittee desires to abandon the activity
authorized herein, unless such abandonment is part of a transfer pro-
cedure, by which the permittee is transferring his interests herein to
a third party pursuant to Gene-ral Condition "v" hereof, he must restore
the area to a condition satisfactory to the Division Engineer.
t. That if the recording of this permit is possible under applicable
State or local law, the permittee shall take such action as may be neces-
sary to record this permit with the Register of Deeds or other appropriate
official charged with the responsibility for maintaining records of title
to and interests in real property.

u. That there shall be no unreasonable interference with navigation
by the existence or use ;of the activity authorized herein.
v. That this permit'may not be transferred to a third party without
prior written notice to the Division Engineer, either by the transferee's
written agreement to comply with all terms and conditions of this permit,
or by the transferee subscribing to this permit in the space provided f-
below and thereby agreeing to comply with all terms and conditions of
this permit. In addition, if the' permittee transfers the interests author-
ized herein by conveyance of realty, the deed shall reference this permit
and the terms and conditions specified herein and this permit shall be
recorded along with the, deed with the Register of Deeds or other appro-
priate official.

II.. Special Conditions:
That the permittee, upon receipt of a notice of revocation of this permit or
upon its expiration before completion of the authorized structure or work,
shall, without expense to the United States and in such time and manner as the
Secretary of the Army or his authorized representative may direct, restore
the waterway to its former conditions. If the permittee fails to comply with the
direction of the Secretary of the Army or his authorized representative, the
Secretary or his designee may restore the waterway to its former condition,
by contract or otherwise, and recover the cost thereof from the permittee.
The permittee is required to notify this office, in writing, of the exact location
of the disposal site 60 days in advance of the intended use of the site. The
proposed disposal site shall not be used until the permittee has received
written authorization from this office.
