INSTRUCTIONS
a. This application must be completely filled in by typewriter or in ink and submitted to the Building Inspector,with 3
:s of plans,accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
don.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issued a Building Permit to the applicant. Such permit
ill be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
ill have been granted by the Building Inspector.
APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant to the
Lilding Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws,Ordinances or
:gulations, for the construction of buildings, additions or alterations, or for removal or demolition, as herein described.

FACTS
On or about December 10 , 1984, Curtis W. Horton, as Building
Inspector of the Town of .Southold inspected the premises owned by
Andrew C. Fohrkolb on the northwesterly corner of Lipco Road,
Mattituck , Town of Southold, New York (Suffolk County Tax Map

Designation: District 1000, Section 141. 00 , Block 03. 00, Lot j
017. 00) and found defendant had: - reconstructed and structurally
altered a building located on the northerly portion of the premi-'

ses into a one-family dwelling by installing a new roof, plumbing;
j and electrical service as well as erecting an addition on the
rear of the existing building. all without obtaining a Building
Permit from the Building Department of the Town of Southold
contrary to the provisions of the Code of the Town of Southold inl
i
such case made and provided. i
On or about December 10, 1984, Curtis W. Horton, .as Building
Inspector of the Town of Southold issued an Order to Remedy
Violation notifying the defendant to comply with the Southold
Town Code and to remedy the above conditions contained in the
Order to Remedy Violation on or before the 24th day of December,
1984. On January 30 , 1985, Curtis W. Horton, as Building Inspec-I
for inspected the premises and found defendant was still main-
taining two, one-family dwellings on his property; the defendant
had not obtained a Building Permit for the reconstruction and
structural alteration of the building located on the northerly.
portion .of his property contrary to the _provisions of the
Order to Remedy Violation and the provisions of the Code of the
Town of Southold in such case made and provided.
The above allegations of fact are made by the Complainant
herein on direct knowledge and upon information and belief with
the sources of the Complainant's information and the grounds for
his belief being facts contained;:. in the files of the Building
Inspector of the Town of Southold.
WHEREFORE, Complainant prays a criminal summons be issued
directing the defendant, ANDREW C. FOHRKOLB, to appear before

Emma Parker being duly sworn deposes and says:
That I am 35 years of age and I reside in the second floor apartment in the
house owned by Andrew Fohrkolb on the northwest corner of the intersection of Sound
Avenue and Lipco Road, Mattituck, New York.
While I have only lived in this apartment since June or July of 1980, I have
known the property since 1969 or 1970 when I first met my husband who lived two
houses away.
The small cottage in the rear of the premises has had someone living in it for
as far back as I can remember.
I know that for about a year back around 197.4, 1975, or 1976 the cottage
was being lived in by a minister, his wife, and their two sons.
There were a number of other people who lived there both before and after
the minister, but I do not know their names.
When I moved into my present apartment in 1980, a friend of my mother's by
the name of Joseph Hamilton was living in this cottage. In the summer of 1982 he
went down south to go to his mother's funeral, but then he died before he ever got back
to New York. Shortly after that his sisters came and took all of his belongings.

Later that year some seasonal workers from Agway lived there. They left
when the cold weather came.
The only person to live there after that was Andrew Fohrkolb's son who lived
there for several months last summer.
I also know that Dolly Lawson, who is a little older than I am, .was born in
that cottage and lived there as a small child. Her maiden name was Dolly Funn.
The longest time that I have ever known that cottage to be vacant was since
Andrew Fohrkolb's son moved out, last year and Andrew Fohrkolb began to fix it up.
Prior to that it was almost always occupied.

r. FACTS .
On or about December 10, 1984, Curtis W. Horton , as Building
Inspector of.-,the Town of .Sou'thold inspected the premises owned by
Andrew C. Fohrkolb oh' the northwesterly corner of Lipco Road,'
Mattituck, Town of .Southold:r New York (Suffolk County Tax Map
Designation: District 1000, Section 14.1. 00 , Block 03 . 00 , Lot
017.00) and found defendant had: altered, reconstructed, and
converted a building,, located on the northerly portion of the
premises into,: a One .family,:-.dwelling by installing a new roof ,
suonsheetwidows, rock, plumbing and, electricity
as well as lip n addition on the rear of the dwelling all
without obta�ninc a`, uildig Permit from the Building Department

of the Town of Southold al;.-.Contrary to toe provisions of the
Code .of...the'.'Town', of',Southold in such case made and provided.
ON or about Decembez! .l'0", 1984, Curtis W. Horton , as Building
Inspector of .the;:•Town •'.of. Southold issued an Order. to Remedy .
Violation no't fy ing�;the defendant ,to comply with the. Southold ' .
Town Code, and to''.'.remedy...the above conditions contained in . the _
Order to Remedy Violation on, 'or: before the 24th .day' of December,
1984. On January,. 30, ,198,5. :_ Curtis W. Horton, as .Building Inspec-
tor inspected 'the :premises and found defendant was still main-
taining two, one-family dwellings on his - property; the defendant
had not obtained ,a `Building. Permit for the alteration, recon-
structiom "and conversion df. the building located on the .northerly
.portion of'•'-hls -pr"operty_ all contrary to the provisions of the
Order to.:Remedy Violation` and the <provisions of . the Code of the

1. Th.Iat I am 20 years old and reside with my father, Andrew C. Fohrkolb,
at Holden Aven'ue,. Cutchogue, New York.

2. ThAt sometime during July, 1984, my father and I removed all the material
ithat my father had stored in the cottage on the rear "of his property on Lipco Road'
in Mattituck, New York.

3. We then fixed up the main part of the cottage, and I lived in the main
part while we �ontinued to work on the rear part of the building.
4. It imvas probably the early part of October, 1984 that I decided to go back
home and live v ith my father in Cutchogue. I would estimate that my total time living
in that cottage in 1984 was approximately three months.

building and all other structures showing the uses, square
footage as presently exist; and plan showing the proposed
repairs and changes . by the. variance application ; ._
