It would be the Department's recommendation that the dwelling be placed no closer than the 72' proved in permit 10-84-0042. We would recommend a 10' front yard variance from the Southold Town Board of Appeals for this project. Since this lot.has been approved in 1965, Environmental Protection Regulations have changed drastically, as you?-,well know. Therefore, in this time and age we feel it is very important to protect tidal wetland resources and values than all of the required front yard setbacks of these subdivided lots. Local Law No. 4 - 1985, amends Article XI of the Zoning Code by adding thereto a new Section 100-.119.2 which provides setback. restrictions with respect to buildings. located adjacent to water bodies and wetlands. The local law was adopted by the Town Board on March 26, 1985, and became effective upon its filing with the Secretary of State. The local law was transmitted to the Secretary of State on March 27, 1985, and it is presumed that it took effect on March 30, 1985. There was no provision in this law which made any exceptions with respect . to building applications. I understand because of the wetland adjacent on East side of lot, house will be built within 25 feet of the road (Meadow Lane) . This will be in violation of the Covenants and Re- strictions pertaining to Mattituck Estates, which stipulate that no house shall be erected within fifty feet of the road. These covenants were recorded on October 8 , 1965 and shall be binding for twenty five years of said date and renewable for ten year periods thereafter.
