WHEREAS , a public hearing was held and concluded on September 129
1985 in the Matter of the Application of RUTH ENTERPRISES under
Appeal No . 3379 ; and
WHEREAS , the board members have personally viewed and are familiar
with the premises in question , its present uses., and the surrounding
area; and
WHEREAS , the board has considered all testimony and documentation
submitted concerning this application ; and it is noted for the record
that there has been no public opposition ; and
WHEREAS , the board made the following findings of fact :
1 . By this application, appellant requests variances for this
proposed shopping center : (a ) for. insufficient land area ,, having
less than one acre as required b.y Article VI , Section 100-62 (B) ;.
(b ) for insufficient lot width , having less than 150 feet lot width

site plan and floor plan amendments of September 4, 1985] .

Matter of RUTH ENTERPRISES
Decision Rendered September 26 , 1985
2 . The premises in question is situate on the south side
of Middle Road (C. R. 48 ) , Peconic , contains an area of 21 , 922 sq .
ft:- a.nd lot width (frontage ) of 108. 73 feet . This property is
located in the " B-1 " Zoni.ng Use District , and is proposed on
the Amended Master Plan Zoning Maps to. be "Limited Busines-s " (LB) .
3. The subject premises is presently improved as follows :
(a ) 8 ' by 20 '. .frame shed structure set back approximately 50
feet from the rear property line; (b) 6 ' by 6 ' accessory frame
shed structure ; (c ) __. 12 ' by 52 ' mobile home with offi.ce_ .along
the westerly side property line ; (d)_.. 32 ' by 20 '. frame building
set back a.pproximatel_y 55_ feet from the fron.t property line and
15 feet from the east side property line .
4. It is the understanding of .this board that the existing
structures will all be removed entirely from the premises .
5 . The new bui'ldi,ng is proposed to be an one-story,
90 ' by 60 ' building of concrete block construction to be_ set
back 50+ feet from the front property line , 30 feet from the
westerly side property line , 15 feet from the easterly side
property line , and 48. feet from the rear property line (at its
nearest point ) . - .
6 . It is . noted for the record that at a Regular Meeting of
the Planning Board held August 26 , 1985, review was made of the .
floor plan as amended, and it was the position of the Planning
Board (.by letter dated August 28 , 1985 ) that the- number of parking
spaces shown is sufficient with the limited office and retail sales
areas .
7 . It is further noted for the record that the site plan
was amended pursuant to the Pl-anning Board' s request dated _.
September 4, 1985 , and the records show no further action by
the Planning Board to date , pending action by the Z. B. A.
8 . It is the opinion of the board that although the
existing easterly sideyard is. established at 15 feet , that it is
not the minimal necessary under the circumstances. It is ,
however , the opinion of the board that by allowing the total
of three business office uses requested ._in .o_ne building - rather
than as exist will not be adverse to this zoning district or
neighboring properties , nor will the uses be inconsistent with •-
the. present zoning or the proposed zoning amendments .
9. The three uses to be proposed. are : (a) masonry-busi.-
ness office ; (b) electrical business_ office ; (c ) general,
business office .
In considering this appeal , the board finds and determines
that : (a ) the business uses as proposed are consistent with
and will promote the general purposes of the zoning code and
maps [and the. Master Plan amendments as proposed] ; (b ) the
circumstances are unique ; (c) there will not be a substantial

not be adversely affected b-y the proposed business use and its
location ; (h ) the interests of justice will be served by allow-

RESOLVED , to GRANT -the following relief in the Matter of
Appeal No . 3379 , Application of. RUTH ENTERPRISES:
1 . Approval of the insufficient lot area of 21 , 922 sq . ft .
and insufficient lot width of 108 . 73 feet for the proposed
three business-office uses i.n .this "s.hopping center . "
2 . Approval of not less than 18 parking spaces (the
15 as shown plus an additional three. spaces ) .
3 . Approval of an insufficient setback from the easterly
property line at .not less than 20 feet . (30 feet from west line ) .

INSTRUCTIONS
a. This application must be completely filled in by typewriter or in ink and submitted to the Building Inspector, with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.
APPLICATION IS HEREBY MADE to the Building Department.for the issuance of a Building Permit pursuant to the
Building Zone Ordinance of the Town of Southold, Suffolk County, New York, and other applicable Laws, Ordinances or
Regulations, for the construction of buildings, additions or alterations, or for removal or demolition, as herein described.
The applicant agrees to comply with all applicable laws, ordinances, building code, housing code, and regulations, and to

home and a trailer on the site in. question. To construct a
commercial building today.. the cost is prohibitive', therefore,
it is my intent tv rant two of the offices to offset the bank
loans and taxes while I' occupy one: of the offices for `my

vicinity of this property and in this use district because

The following action was taken by the Southold Town
Planning Board, Monday, February 10 , 1986 .
RESOLVED that the Southold Town Planning Board approve
the site plan for "Ruth Enterprises" for construction of
officeswith storage located at North Road, Peconic, survey
dated as last amended January 31, 1986; subject to:
1. An one-year review and field inspection prior
to the issuance of a certificate of occupancy.
It was noted that this site plan received certification
from the Building Department, variances from the Board of
Appeals, and a waiver from the moratorium from the Town Board.

THIS IS TO CERTIFY THAT THE FOLLOWING RESOLUTION WAS ADOPTED BY THE
SOUTHOLD TOWN BOARD AT A REGULAR MEETING HELD ON OCTOBER 22, 1985:
WHEREAS,. Joseph..Clifford Cornell, on behalf of Ruth Enterprises, has requested
that this Board waive the provisions of Local Law No. 14 - 1985 with respect to
his application presently pending before the Planning Board and the Building
Inspector, and
WHEREAS, Joseph Clifford Cornell appeared before this •Board and explained the
nature of the uses for which he proposes to use the premises in question, and
WHEREAS, this Board finds that the applicant proposes to construct a new build-
ing to house three business offices, and
WHEREAS, this Board deems such use consistent with the uses in a Limited Business
District as proposed by Raymond, Parish, Pine & Weiner, Inc.'s Master Plan Update
Zoning Code revisions, .
NOW,.. THEREFORE, BE IT RESOLVED that the applicant be and he hereby is granted
a waiver of the provisions of Local Law. No. 14 - 1985 to the extent of permitting such
uses on said premises as set forth in his application presently pending before the
Southold Town Planning Board for a site plan and the Southold Town Building Inspecto
for a building, permit, subject, however, to the applicant obtaining any and all permits
and approvals required by all Town and other governmental agencies having jurisdictioi
thereof.

For a year now, I have been trying to construct a building
on Route 48, Peconic.
After the necesary procedures were followed with the Building
Department, Planning Board and Zoning Board of Appeals, .the application
was approved, with recommendations, as of October 3. Since the
moratorium is supposed to become effective October 7.and the Planning
Board meets on the same evening, I am seeking relief from the
moratorium. This technicality would. impose a definite hardship
due to the facts that reels of electrical cable, conduit, etc.
would be exposed to the weather for some time and will also be
v�nerable to theft. .
The application is in the name of Ruth Enterprises.

I-n reviewing the above application at our Regular Meeting
held- on July 18 , 1985 , it was noted that the Building Inspector
disapproved your .initial application for four reasons : (1 )
insufficient land. area , (2 )_ insufficient lot width (3) i.nsufficient
sideyard setbacks , and (4 ) insufficient parking spaces .
The adjacent property owners were notified by you that the
relief being requested was for (1 ) insufficient land area and
(2 ) insufficient lot width . In the event that you are requesting
relief for items 3 & 4 additional notice by certified mail by
you will be required in accordance with Section 100-125 of .the
Code . Also , items 3 & 4 are not reflected in your variance appeal .
Upon receipt of the above , together with written comments
or recommendations from the Planning Board , and a Disclosure
Statement disclosing the principals of both corporations (the
owner , C & D Realty , and the contract vendee , Ruth Enterprises ) ,
by August 8th , we will be in a position to schedule and advertise
this matter for a public hearing to be held the latter part of
August .

MR. CHAIRMAN : Yes the building ' s to the south , . but I don ' t
have any dimension of how far the building would be .
MR. BERKOSKI : Do you have the stairway there?
MR. CHAIRMAN : Yes .
MR . BERKOSKI : Well , approximately 20 feet from the stairway .
MR. CHAIRMAN : It shows on the survey two bulkheads . Is that
correct , sir?
MR. BERKOSKI : Yes , it is .
MR, CHAIRMAN : So this is mounted right on top of the second
bulkhead basically .
MR. BERKOSKI : That ' s correct .
MR . CHAIRMAN : Ok . Did they -propose to put any lavatory facili -

legal notice of hearing and appeal application for the record .
CHAIRMAN GOEHRINGER : I have a copy of a site plan dated
June 27 , 1985 indicating a proposed building of approximately
60 ' by 90 ' and site plan including approximately 15 parking
spaces , seven of which will be in front of the building , and
approximately the remaining in the rear with a setback of
approximately 24 feet from the west side and 15 feet from the
east side . . And I have a copy of the Suffolk County Tax Map
indicating this property and surrounding properties in the area .
Mr. Cornell , would you like to be heard?
JOSEPH C . CORNELL : We have complied with the recent
recommendations of the Planning Board which state that the
existing building as well as a mobile home would be removed .

In reviewing the above application at our Regular Meeting
held on July 18 , 1985 , it was noted that the Building . Inspector
disapproved your initial application for four reasons : (1 )
insufficient land area , (2 ) insufficient .lot width (3) insufficient
sideyard setbacks , and (4) insufficient parking spaces .
The adjacent property owners were notified by you that the
relief being requested was for ( 1 ) insufficient land area and
(2 ) . insufficient lot width . .. In the event that you are requesting
relief for items 3 & 4 additional notice by certified mail by
you will be required in accordance with Section 100-125 of the
Code . Also , items 3 & 4 are not reflected in your variance appeal .
Upon receipt of the above , together with written commentsri
or recommendations from the Planning Board , and a Disclosure �' 4
ev3 Statement disclosing the principals of both corporations (the
owner , C & D Realty , and the contract vendee , Ruth Enterprises ) ,
