Mr. Orlowski: We have many times . r Michale Hall, esq. was present for a pre-submission conference iscuss the site plan of Nicholas Petikas for construction of ilding to contain a 2,000 square foot restaurant and 1000 re feet of retail use . This proposal is located at the corner of Main Road and Soun& Road, Greenport. Mr. Hall explained that approximately 50% of the propoerty is in a B zone and the remaining 50% ,approximately, is in an A..zone. He stated however, that this may be on a down side effect, in other words , more of the property is actually zoned A. However, this would have to be studied on the zoning to obtain the exact percentage . Mr. Orlowski sdid..that the more stringent zone applies, therefore, there would be a problem in:'developing this site . Mr. Orlowski said the Board has reviewed about four proposals for this property over the last few years , and due to the zoning, nothing has been finalized with any of those plans . Mr. Hall questioned if the building and parking were all in the B area of the property if the problem would be lessoned. Mr. Hall said the property was about 21 ,000 square feet. Mr. Orlowski said that minimum. quare footage required in a B zone - is 30, 000 and since it is obvious that there is less than that, the Board would not be in favor of this proposal . It was also noted that there could be no -parking in the A zone . Mr. Latham noted that there is a severe flooding problem in the road at this intersection. Mr. Hall said that he realized .that this proposal had to be approved by the Board of Appeals , and it was recommended that he receive the necessary variances prior to action by the PLanning Board. The appointment of Anthony Tohill was cancelled since Mr. Tohill could not be present. This will be rescheduled on the next available agenda. This discussion was regarding the set-off of Louise 0. Day located at Indian Neck Road, Peconic. On a motion made by Mr. Edwards , seconded by Mr. Latham, it was RESOLVED that the Southold Town Planning Board offer the following comments to the Zoning Board of Appealls regarding the proposed minor subdivision of Guy acid Ruth Sobering located at Sound Avenue, Mattituck to create 2 lots on 2 . 9 acres . 1 . The lots proposed are less than the c i°rent two-acre zoning, and there appears to be a house and a foundation already existing on the property upon field inspection. V. McGuire, 35 App.Div.2d 567 (1971), "a merger is not effected merely because adjoining parcels come into common ownership". In fact, it has been the undisputed law in the State of New York that, not only do lots in different adjacent use districts fail to merge because of common ownership, the lots are deemed to continue in single and separate ownership regardless of the common ownership; as ownership of both does not constitute a true merger. 12 N.Y.Jur.2d Building, Zoning, and Land Controls, Sec.149; 2 American Law of Zoning 3rd Sec.9.67; As further stated in Creamer v. Board of Zoning Appeals of the Town of Hempstead, 16 Misc.2d 676 at 679 Sup.Ct.Nass.Cty.,1956 : 'any adjoining?an Qninfthelordinancethe language contemplates any land in the same use district (emphasis in original) which not only abuts on, but can be used in conjunction with the property in question." Therefore, the common ownership of the two separate lots in the different use districts does not effect a merger of the properties into one single lot; but rather, the separate lots continue in single and separate ownership in spite of the common ownership. `"TP Y� l i �n Bennett Orlowski, Jr., Chairman April 27, 1987 Page two / Turning to the Board's interpretation of Sec.100-22D of the Town Code, it is the applicants' position that the hardship provisions contained in that section are inapplicable to this zoned application, as both lots resort by may be used for the purposes they were the applicants to this provision of the Code. Furthermore, the attempt by the Board to force a more restrictive use (A-Residential) on the less restrictive (B-1-Commercial) lot flies directly into the clear meaning of the section and imposes a hardship on the owners of the properties not intended by the Code. The clear meaning of Sec.100-22 recognizes the hazards of split lot zoning and it makes special provision for relief from hardship in cases where lots are split either by necessity or inadvertence. This is done so as to alleviate the need for a variance and our ordinance allows the landowner in specific cases the right to extend a less restrictive use (B-1) into the more restrictive one (A), and certainly not the reverse situation, as proposed by the Board. .As in all matters involving zoning restrictions and regulations, they angst be strictly construed against the municipality which seeks to enforce them. Thomson Ind. v. Incoroorated Vil.of Port Washin. ton North, 27 N.y.2d 537 1971 Matter of 440 East 102nd St.Corp. v. Murdock 285 N.X.298 (1941); and any ambiguity in the language used in the regulation or restriction must be resolved in favor of the property owner. Matter of Turiano v. Gilchrist, 8 App•Div.2d 953 (1959) There is absolutely nothing in Sec.100-22D which requires nor allows the more restrictive zoning (A-Residential) to be forced 30 feet into the less restrictive use of the B•-1 Commercial Zone; to attempt to interpret Sec.100-22D as permitting this conclusion contradicts the clear meaning of the words of the section, and what hardship it attempts to avoid.
