the above appeal was considered, and the action indicated below was taken

WHEREAS , a public hearing was ' held and concluded on June 27 , 1985 ,
in the Matter of the Application of MARION R. AND JOHN M. KING ; and
WHEREAS , the board members have considered all testimony and
documentation entered into the record i.n this matter , including
but not limited to photographs of those businesses existing along
the Main (State ) Road; and
WHEREAS , the board members are personally familiar with the
premises in question and the surrounding uses and use districts ; and
WHEREAS , the board made the following findings of fact :
1 . This is an appeal for a use variance to permit residentially-
zoned property to be used as a real -estate office in conjunction with
the present two single-family dwelling uses on the premises .
2 . The premises in question is located on the west side of
Main Road (State Route 25 ) , and comprises approximately. 33 ,410 sq .
ft . in area. The property is improved with : (a) a single-family
two-story frame house with attached porch ; (b ) a single-family
one-story frame house with attached porch' at the most westerly end
of the premises ; (c ) 22 ' by 49 ' 'storage barn structure ; and
(d ) swimmingpool [as noted on survey mapped March 11 , 1985 by
Roderick VanTuyl , P . C. I . This parcel is designated on the Suffolk
County :Ta"x Maps as District 1000 , Section " 070,, Block 01 , Lot 03 .
All neighboring properties are in the "A" residential and agri -
cultural use district . The dwelling in question is occupied by
the appellants, who plan to use the porch area (approx . 247 sq . ft . )
for the operation of a real -estate office . Although the zoning code
permits certain specified professional offices to be located in a
private dwelling , as an accessory use , subject to specified condi -
tions , a real estate office is not one of these specified uses .
Accordingly , such a use may only be allowed by the grant of a
use variance .
It is well established that before a use variance may be

granted by this board , unnecessary hardship must be demonstrated
by proof that : (1 ) the land cannot yield a reasonable return if
used only for the purpose allowed by the code in that zone ;
(2 ) that the plight of the owner is due to unique circumstances
and not to the. general conditions in the neighborhood; and (3)
that the use applied for will not alter the essential character
of the neighborhood.
At the hearing , the only proof submitted was the statements
, bearing on the suitability of the building and land for the
intended use ( s ) and the character of the business uses existing
.more than 500 feet from petitioners ' property along the west
and east sides of the Main Road. Several of these business
uses to the best of the board ' s knowledge were preexisting of
the zoning ordinance , and a funeral home and church are permitted
in the "A" zoning district by Special Exception . No evidence
was presented to be sufficient on the issue of unnecessary hard-
ship . In the 'absence of such proof, this board may not grant a
variance .
It is the opinion of this board that the appellants '
plight should be addressed to the Town Board with a view possibly .
of rezoning the area along parts of Route 25 for these business
purposes .
Accordingly , on motion by Mr . Douglass , seconded by Mr. Doyen,
it was
RESOLVED , that the relief requested in the Matter of the
Application of MARION R. AND JOHN M. KING for permission to
establish real -estate office in conjunction with present resi -
dential uses , BE AND HEREBY IS DENIED WITHOUT PREJUDICE.

is requested for the reason that we would like to enclose existing porch and
use as a Real Estate office in conjunction with existing family residence.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because petitioner would be forced to go out of business. Petitioner is the
sister of William B. Smith, the founder and, owner of- William B. Smith Real Estate Agency
presently located on Skunk Lane, Cutchogue, NY. The present rent is $300.00 per month
for one room which is not visible from Main Road. Bill Smith died unexpectedly on Miy 21,
1984 and the business by.necessity had to be taken over by his sister, Marion King, the
petitioner herin. Mrs. King had been a licensed salesman with her brother and qualified
as a broker on July 1, 1984 and has been running the business since that date. She is 61
years old and married to John King who recently suffered a serious illness and is in the
process of recuperating. Mrs. King does not have the broad appeal enjoyed by her brother
and must advertize extensively in order to obtain listings and customers. There is absolutely
no office sp ce available on Main Road with adequate parking. Petitioner is thinking to
the future and is looking to cut down on her expense and still maintain a small office
and be able to care for her husband. Both have always been self employed and can not
depend on any retirement income other than the business and Social Security benefits.
She wishes to enclose the present screened-in porch consisting of 240 sq. ft. on her house
and operate a small real estate office from her home which is located on West Main Street
directly across from DeFriest Funeral Home. The hardship is not self-imposed but was
created by the untimely death of her brother. She is not seeking a change of zone but
merely a use variance which would protect the neighborhood more than a zone change.
Reasonable restrictions can be placed on the use as this Board has done in the past under

vicinity of this property and in this use district because the neighborhood is truly a mixed neigh-
borhood. Applicants property is surrounded on West Main Street within a z mile by three
different and possibly four zones. (see Exhibit A attached) On the south side of :the street
is located a zone "c" Industrial and used as a hardware store and Marina. Across Jockey
Creek Dirve is a B-1 General Business Zone which ha.s a gas station on it. In addition to
the above on the South side of main Road there exists Sharp Real Estate, Christian Science
Church, Jim Gray Realty (who has just added an extension), Jeff Rheim Insurance, Tim Gray
Masonry, Lou Baker Welding & Iron Works, and directly acroos the street is 'DeFriest Funeral
Home, and First Universalist Church. On the north side of the street (applicant's side) there
is located Lickety Split Ice Cream, Chair Caning Factory, Medical office-'of Jay Slotkin and
a little further east is located :the American Legion Hall, St. Patrick's Church, and law
office of Ren. Terry. Directly behind applicant is the proposed Meadow Farms, a mulitple
dwelling change of zone.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because as shown above the neighborhood is mixed and this
Board has granted use variances in the past for similar cases. Petitioner is not going to
change the look of her home and has the complete approval and consent of each of her
next door deighbors. There will be no additional traffic problems any more than what
has already been created by the Funeral Home. At present here is an application to change
the A zone directly behined petitioner to an M zone which would create four parcels out
of each acre. The petitioners house as it presently exists contains over 2,400 sq. ft. and
petitioner only proposes to use 1/10th of it, namely 240 sq. ft. Under home use guidelines
Sec. 100-30 (C) she could have up to 30% of the ground floor which would be 360 sq. ft.
and one assistant. The exterior effect is .minimal and under all practical effects the
use would be less impact than use by a doctor or lawyer as set forth in definition of
home use in Sec. 100-13.

close existing porch and use as a real estate office in single-

Chairman read legal notice and appeal application in their entirety
for the record.
MR . CHAIRMAN : Mr . Camin.iti , in appeals of this nature , I usually
ask the attorney if they have any objection to my officiating in
this since I do hold a license, New York State Broker ' s License .

MR . CAMINITI : No objection .
MR . CAMINITI : Mr. Chairman , members of the board . There ' s not
much I can add that isn ' t already in the petition except that
since we filed the petition , Marion King as filed as part of
the record two consent, forms consenting to this application ,
and I also realize that the board made a field inspection of
the premises . I would like to make a part of the record a
series of photographs which depict the area in great detail ,
just for the record . ( Eleven large photographs were submitted
for the file . )
MR . CHAIRMAN : Thank you .
MR . CAMINITI : Another point , as far as I know , when the
Master Plan was first set forth , it contemplated a residential
office , high • density , which would, consist of those on west
Main Street , and we are , this is just the way our application
would read . West Main Street is a truly unique area . C-zones .
Two real estate offices . Church . American Legion on west
Main . And we don ' t feel this would hurt the area in any way .
It is a special use . Architecturally , the building is well
maintained . As far as I know there isn ' t anything being done
in the town now that is going to allow these , for a home
occupation . And it is a large ( ) as far as I know that
is going to be included for a home occupancy . Look at the

variances have been granted to Sharp . Realty , Dr. Slotkin ,

use as a Real Estate office in conjunction with existing family residence.

REASON FOR APPEAL Continued'
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because .petitioner would be forced to go out of business. Petitioner is the
sister of William B. Smith, the founder-and owner of William B. Smith Real Estate Agency
presently located on Skunk Lane, Cutchogue, NY. The present rent is $300.00 per month
for one room which is not visible from Main Road. Bill Smith died unexpectedly on May 21,
1984 and the business by necessity had to be taken over by his sister, Marion King, the
petitioner herin. Mrs. King had been a licensed salesman with her brother and qualified
as a broker on July 1, 1984 and has been running the business since that date. She is 61
years old and married to John King who recently suffered a serious illness and is in the
process of recuperating. Mrs. King does not have the broad appeal enjoyed by her brother
and must advertize extensively in order to obtain,listings and customers. There is absolutely
no office sp ce available on Main Road with adequate parking. Petitioner is thinking to
the future and is looking to cut down on her expense and still maintain a small office

depend on any retirement income other than the business and Social Security benefits.
She wishes to enclose the present screened-in porch consisting of 240 sq. ft. on her house
and operate a small real estate office from her home which is located on West Main Street
directly across from DeFriest Funeral Home. The hardship is not self-imposed but was
created by the untimely death of her brother. She is not seeking a change of zone but
merely a use variance which would protect the neighborhood more than a zone change.

vicinity of this property and in this use district because the neighborhood is truly a mixed neigh-
'borhood. Applicants property is surrounded on West Main Street within a z mile by three
different and possibly four zones. (see Exhibit A attached) On the south side of the street
is located a zone "c" Industrial and used as a hardware store and Marina. Across Jockey
Creek Dirve is a 13-1 General Business Zone which ha.s a gas station on it. In addition to
the above on the South side of main Road there exists Sharp Real Estate, Christian Science
Church, Jim Gray Realty (who has just added an extension), Jeff Rheim Insurance, Tim Gray
Masonry, Lou Baker Welding & Iron Works, and directly acroos the street is DeFriest Funeral
Home, and First Universalist Church. On the north side of the street (applicant's side) there
is located Lickety Split Ice Cream, Chair Caning Factory, Medical office of Jay Slotkin and
a little further east is located :the American Legion Hall, St. Patrick's Church, and law
office of Ren. Terry. Directly behind applicant is the proposed Meadow .Farms, a mulitple
dwelling change of zone.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CF-IARACTER OF THE DISTRICT because as shown above the neighborhood is mixed and this
Board has granted use variances 'in the past for similar cases. Petitioner is not going to
change the look of her home and has the complete approval and consent of each of her
next door deighbors. There will be no additional traffic problems any more than what
has already been created by the Funeral Home. At present here is an application to change
the A zone directly behined petitioner to an. M zone which would create four parcels out
of each acre. The petitioners house as it presently exists contains over 2,400 sq. ft. and
petitioner only proposes to use 1/10th of it, namely 240 sq; ft. Under home use guidelines
Sec. 100-30 (C) she could have up to 30% of the ground floor which would be 360 sq. ft.
and one assistant. The exterior effect is _minimal and under all practical effects the
use would. be less impact than use by a doctor or lawyer as set forth in definition of
home use in Sec. 100-13.
