Town Trustees during its regular meeting held on November 20, 1992 regarding the above matter° WHEREAS, En-Consultants on behalf of Mattituck Fishing Station applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 10, 1992 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, _ " WHEREAS, e public hearing was held by the Town Trustees with respect.' to said application on November 20, 1992 at which time all interested persons were given an- opportunity to be heard, and; WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area,. and, ' WHEREAS, the Board has considered all the testimony and documentation, submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW,, THEREFORE BE IT RESOLVED that the Board of Trustees approves the application of En-Consultants, Inc. on behalf of Mattituck Fishing Station to remove and replace inkind/inplace 360 +/- ,l.f. of timber bulkhead and dredge up to 10' off bulkhead to maximum depth 4' below MLW. Approx. 86 c.y® of spoil will be removed and used to backfill bulkheads. An existing 6' X 20' section of fixed walkway and 'rip-rap adjacent to launching ramp will be removed and replaced. The existing 16' X 20 ' launching ramp will be resurfaced with concrete. Add ( 5) 2.5 ' X 16 ' fingers and ( 3) 2. 54, X 16' fingers to. sections of .existing main floats as shown on plan. A drain gutter has been added at the upper end of the launching -ramp. The backfill of the northerly sections of the bulkhead has also been indicated as sand and gravel with an upper layer of stone. The above all in accordance with request of the DEC and Trustees as per revised survey of October 6, 1992. This permit will expire- two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Permit will be issued upon payment of the following fees for work. Approximately 85 c.y. of spoil to be removed and used to backfill bulkheads . An existing section of bulkhead and rip-rap adjacent to launching ramp to be removed and replaced with a 55 ' section of bulkhead only, which is not to interfere with launching of boats. The existing 10 ' x 48 ' launching ramp to be resurfaced with concrete. Add five 2 . 5 ' x 16 ' fingers and three 2 . 5 " x 16 ' fingers to sections of existing main floats as shown on submitted work plan. The CAC recommends approval provided the applicant follows town policy as is enforced at other .marinas by adding storm water drainage systems to handle surface water runoff. The CAC also suggests the applicant add a 3 ' - 4 ' gravel bed adjacent to the bulkhead. Naugles Drive, Mattituck. Vote of Council: Ayes: All Notion carried. RESOVLED to recommend to the Southold Town Trustees approval with suggestions of Wetland Application No. 99-4-23 of William Ahmuty and wife to add 10 ' to rear waterside of existing residence. The CAC recommends apprroval with the. stipulation that , if in new construction, a readjustment of the cesspool/septic system is required, that the pool( s ) be moved as far away from the water as possible. Also, since there will be disturbance due to the construction, the applicant plant a natural vegetation buffer be planted within 20 ' of the bulkhead. A current licensed land survey with elevations of the entire site at minimum of 2' (two foot) contours which in- addition to land features shows all docks and accessory in-water, structures such as piles, cables, floats and ramps. 2. A statement as to the. current marina capacity and diagram of the in-water boat layout as well as the winter storage configuration in the upland area. 3 . A detailed parking plan detailing how parking will be handled on site. The Trustees are concerned that the site is expanding and must be subject to a full review by the Planning Board. Please provide more detail concerning the proposed boat ramp surface. With the replacement concrete be poured in-place or will it be of a pre-cast nature? 2. What is the total boat capacity of the marina now and what will be the change in capacity following the proposed addition of finger docks? 3. How will the addition of slip space affect the present availability of parking on the property? How many parking spaces are there presently and how many will be available following the work? Please indicate the present stormwater runoff situation on the site. Is the present parking area paved or is it -surfaced with permeable materials? What changes will occur in runoff patterns following the expansion? 4. Please indicate the lengths and drafts of the vessels that are now and that will be using this facility,'. . We request that the photographs supplied earlier be transferred to this current application. My client was unable to respond in a timely manner to the items listed in your October 30, 1991, letter due to illness in the family. Now, however, he wishes to proceed with the project. The boat ramp surface will be poured in place, using forms. This is done by means of a funnel-like piece of equipment, which channels the concrete into one specific area at a time. The greater weight of the concrete dis- places the water and prevents dilution. This is normally done at low tide. I ,believe there is a misconception over what is proposed in this project. The (8) finger floats that we propose to install against the floating docks parallelling the bulkhead are actually pre-existing structures, which were located elsewhere in the marina since prior to my client's purchase of the property many years ago. Mr. Michael Corey - 2 - February 5, 1992 The (5) southerly fingers were located on the west side of the floating dock lying farther out in the creek. The (3) northerly fingers are simply reconstruction of fingers that were present. - there previously but were removed during a reconfiguration of the marina. As ` evidence thereof, I enclose a portion of a survey that shows fingers in these locations. Therefore, it is very important to note that. this proposal does not seek to expand the capacity of the marina. At the present time, there are 45 boat slips for rent and also 15 rowboats rented by ;the marina on a daily basis. The sizes of the boats kept here are 15 ' to 251 , primarily outboards and inboard/outboards. The rental rowboats are 1519". The wording of the project de- scription has led agencies to believe that this was an expansion, but this is emphatically not the case. . This fact now bears upon our response to your Item 3 in that there is no proposed; expansion to the current 60 parking spaces available. The driveway into the facility is paved while the remaining parking areas are gravel. This allows storm water runoff to percolate into the ground except during periods of extremely heavy rainfall. Regarding a pumpout facility, virtually all the boats have port-a- potties, rather than marine toilets. Thus, a pumpout would be little used and not economical to operate. If, however, this is a condition of approval, my client has indicated his willingness to purchase a portable pumpout that can be kept on the upland and,wheeled to the dock as necessary. Marinas are obviously water-dependent. As such, this existing facility should be permitted to undertake a I minor reconfiguration and improvement that would upgrade the facility and create safer and more convenient docking and launching areas. We see no policy that prohibits this proposal, nor do we feel it will in any way degrade the environment. There are several other commercial operations in this area, and thus, no precedents are being set. Except for (1) 2.5 ' x 16 ' finger float, all other finger floats have been shifted from the easterly floating docks to the westerly floating docks that parallel the bulkhead. The configuration and dimensions of the launching ramp also differ from that which was pre- viously shown. In fact, the ramp has a slight dog leg to the north and measures approximately 20 ' x 601 . Rip-rap is located on both the east and west sides. In order to replace this structure, we now propose to remove and/or backfill all rip-rap. On the easterly side, a new 60 ' free-standing bulkhead will be built, which will extend off an exist- ing 15 ' section of bulkhead located on the south side of an existing fixed section of walkway. Existing bulk- heads on the westerly side of the ramp, which now total 521 , will be removed and replaced and extended by 3 ' so that the originally-proposed 55 ' still remains valid although the slight angle will be recreated unless a straight 55 ' section is approved by the NYSDEC and other agencies.
