The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees• of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and 'any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by this. permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon the premises where such operations are being conducted to make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. This operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C'. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat_thereof. E. Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. H. Weaken or undermine the lateral support of other lands in the vicinity. I. Otherwise adversely affect the health, safety and general welfare of the people of the town. Country Road Wading River, New York 11792 RE: Mattituck Park Commission Dear Mr. Just: The following action was taken by the Board of Trustees at a regular meeting held on December 26, 1985: Moved by Trustee Bredemeyer seconded by Trustee Bednoski WHEREAS, the Land Use Company on behalf of the Mattituck Park Commission applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application no. 320 and dated August 13, 1985 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findigns and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on December 26, 1985 at which time all interested persons were given an opportunity to be heard, WHEREAS, the Board considered all testimony and documentation submitted concerning this application; and it is noted for the record that there has neen no public. opposition; and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the Town, NOW, THEREFORE, BE IT RESOLVED that the Land Use Company on behalf of the Mattituck Park Commission be granted permission under the provisions of the Wetland Ordinance of the Town of Southold, New York, all in accordance with the application submitted. This permit will expire on December 26, 1986 if work has not commenced by said date. There shall be two inspections required; and the Trustees shall be notified when the project is complete. -2- Please be advised that there is a $5 . 00 Wetland Inspection Fee which is now due and payable. You will recall that on July 2, 1986, a waiver was issued with respect to proposed work at Wolf Pit Lake. This waiver did not contain an expiration date, but did request that spoil be trucked to an approved upland site and that the fringe must be left in the natural state. We are asking at this time, that permission be granted for spoil to be placed on adjacent property of the Park District - the triangular piece of property to the east of Wolf Pit Lake and Tuthill Lane. We are also asking for approval of our plan to re-grade, re-vegetate, and plant trees in the work area after completion. The proposed restoration area is shown on the .attached survey. Pursuant to Section 97-32 of the Southold Town Code we request a hearing before 'the Trustees. A copy of the notice of violation is annexed hereto. The notice of violation should be rescinded for the following reasons: (1) Mattituck Park District was granted a waiver of the Wetland Ordinance for work to be performed at Wolf Pit Lake by letter dated July 2, 1986. A copy is annexed hereto. (2) No spoil was intentionally placed on Tuthill Lane. Any spoil inadvertently deposited on Tuthill Lane in connection with the work has been or will be removed. (3) Spoil is to be placed on adjacent property of Mattituck Park District, to wit: ,a triangular piece of property to the east of Wolf Pit ,Lake and Tuthill Lane. Approval is requested for this site for deposit of spoil. (4) Mattituck Park District intends to regrade, revegetate and plant trees as appropriate upon completion of the work. M. , at the Southold Town Hall, Main Road, Southold, New York. Present were: Martin H. Garrell - Chairman John Tuthill - Member Ralph Condit - Member John Holzapfel - Member Heather Cusack - Member Jeanne Marriner - Member Betty Wells - Member Linda J. Cooper - Secretary Also present were: Mr. Bergman Henry Smith DISCUSSIONS: Mr. Bergman (Planning Board referral - Proposed Subdivision) appeared before the Council to explain the exact location of the proposed house in relation to the slope and marsh area. At the. Council ' s request, Henry Smith was in attendance to answer the questions, raised at the previous meeting regarding his Wetland Application No . 313. Regarding the amount of dredging to take place, Mr Smith informed the Council that the application had been -amended from the original 1000 c. y. of dredging to 96 c.y. When questioned about the placement -of dredge spoils , he explained the dredge spoils would be loaded on a barge and unloaded at Goldsmith' s, then trucked away. The Council also wished to know if there had been any dredging . done in the same area in the historic past . According to Mr. Smith, the County had dredged in the area up to the park at the end of Youngs Avenue. REPORTS : Heather Cusack, _the Council' s STOP representative reported the program for 1986 would begin organizing in February and start getting information out to the public with special attention being given to businesses. Ms . Cusack also reported 'on a request received from Councilman Paul Stoutenburgh. Councilman Stoutenburgh.. would like the CAC to .- Page 2 make up a map showing all the places in the area with drainage pipes going into creeks. It would help pinpoint sensitive areas . The Council felt that it was a worthwhile project . Council Chairman Martin Garrell will contact Paul Stoutenburgh to set up organizing and financing the project . The members of the Council thought it would be best to hire someone, possibly a college student , to do the actual legwork. Chairman Martin Garrell reported .that he is planning a joint meeting for a Saturday, sometime in January of February, between the Southold, East. Hampton, Southampton, and possibly Riverhead CACs and Conservation Boards . RECOMMENDATIONS : On a motion made by John Tuthill, seconded by Ralph Condit it was RESOLVED to recommend to the Southold Town Planning Board approval of the Proposed Subdivisiori of Martin and Barbara Bergman. The Council approves with the stipulation that care be used during excavation and that the natural vegetation be kept as a buffer between the house and marsh area to avoid run-off .
