In the Matter of the Application of NICK AND ANNA ANDRIOTIS, 21120 Sound-
view Avenue, Southold, NY for a Variance to the Zoning Ordinance, Article
III, Section 100-119 .1 for permission to erect fence exceeding four feet
high in the frontyard area of premises at the northwest corner of inter-
section with Clark Road and Soundview Avenue, Southold,. NY; County Tax
Map Parcel No. 1000-51-3-14 .
The board made the following findings and determination:
By this appeal, applicants seek permission to retain an exist-
ing stockade fence located at the southerly property line of the
premises in question commencing at a point approximately 50 feet
west of Clark Road and extending to the most westerly property line
at a maximum height of five feet. The premises in question is
shown on the Suffolk County Tax Map as District 1000, Section 51,
Block. 3, Lot 14, and is improved with one one-family dwelling set
back a minimum of 83 feet from Soundview Avenue and 150 feet from
Clark Road. Adjoining the subject premises on the south is a
parcel of land improved with one one-family dwelling which is
set back from Clark Road approximately 50 feet.
For the record it is noted that the abutting premises on the
south could be issued a building permit for the same project
requested by this variance inasmuch as his frontyard area ends
at the 50-foot mark, and the premises in question has a frontyard
area from the 150-foot mark (from the existing house) . The _.
zoning code permits fences only in the side and rear yard areas
at a maximum height of 616." ; _however, frontyard areas. are permitted
fences at a maximum height of four feet.
In considering this appeal, the board determines: (1) that
the practical difficulties. have been shown and are sufficient to
warrant the granting of the application as noted below; (2) that
the relief as noted below is substantial in relation to the
requirements of the zoning code; (3) that the circumstances are
unique; (4) that the relief as approved will be in harmony with
and prompte the general purposes of zoning of the protection and
promotion of the. public health, safety and welfare; .(5) that the
interests of justice would be served by approving the application
as noted below.

On motion by Mr. Douglass, seconded by Mr. Grigonis, it was
RESOLVED, that Appeal No. 3180, application of NICK AND ANNA
ANDRIOTIS for permission to retain five-foot high stockade fence
along the southerly boundary line within the frontyard area,
BE AND HEREBY IS APPROVED, SUBJECT TO THE FOLLOWING CONDITION:
1 That the fence shall not exceed a height of four feet within
the first 50 ' of Clark Road, as exists at the present time.
Location of Property: 21120 Soundview Avenue and Clark Road,
Southold, NY; County Tax Map Parcel No. 1000-51-3-14.
Vote of the Board: Ayes: Messrs. Goehringer, Grigonis,

b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets
or areas, and giving a detailed description of layout of property must be drawn on the diagram which is part of this appli-
cation.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application,the Building Inspector will issued a Building Permit to the applicant. Such permit
shall be kept on the premises available for inspection throughout the work. '
e. No building shall be occupied or used in whole or in part for any purpose whatever until a Certificate of Occupancy
shall have been granted by the Building Inspector.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because The Dakis family has easy & unnoticable entrance
to my property (andriotis) . The Dakis family complains constantly
of my dog walking on there property and has thrown objects at my
dog. I have planted several types of bushes at the immediate
openings and Mr. Dakis has openly .admitted to pulling them out,
even though there on my property. I (anna andriotis) am at my .
home alone on many occassions and have had Mr Dakis frighten-me
upon his entrance to my garage, because he enters through his
side yard. My (andriotis) home is situated towards the rear of
the property line. I would therefore request a 5 ft. fence from front
of Dakis house to back .of property line to obstruct there view
of my grounds and as to my presents or absence.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because Mr. Dakis' s house is within
18 inches of my property line. His outdoor entertainment area
is in the rear of his house can become 'very inconvenient to my
outdoor activities (hobbies) and my personnel entertainment.
Mr. ' Dakis can gain - entrance to my property unseen by any other
person: He- has entered my property and destroyed .shr-;.;ubs, moved
my property marker and other numerous destructive acts. The area
which I request 5 ft. of Stockade fence to be is approximately
50 ft from the street, and therefore would not be taking away
from any scenic view. My. house is situated in the rear of my
property and that' s why I would want 5 ft of fence to begin at
the front of Mr. Dakis' s house.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because The area which I request five feet of
fence is unobservable from the street. My home is surrounded by
trees and bushes on Clark Road and Soundview Ave and therefore
the,- 5-,ft ,stockade fencing cannot be seen from any of the roads
thus not changing the character of the neighborhood. My situation
is such were because my home is situated all the way to the rear
of my property as seen on the survey, I would want the 5 ft fencing
to begin at the front of the Dakis house since I only have
approximately 30 ft from the front of my home to the end of
my property.

1. , STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-

my dog walking on there property and has thrown objects at my dog.
I have planted several types of bushes at the immediate openings
and Mr. Dakis has openly admitted to pulling 'them out, even though

many occassions and have had Mr. Dakis frighten me upon this entrance
to my garage, because he enters through his side yard. My (andriotis)

stockade fence to be is approximately 50 ft. from the street, and
therefore would not be taking away from any scenic view. My house
is situated in the rear of, my property and that' s why I would want
5 ft of fence to begin at the front of mr. Dakis' s house.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because The area which I request :five feet of
fence is unobservable from the street. My home is surrounded by
trees and bushes on Clark Road and Soundview Ave. and therefore
the 5 ft stockade fencing cannot be seen from any of the roads
thus not changing the character of the neighborhood. My situation
is such were because of my home is situated all the way to the rear
of my property as seen on the survey, Iwould want the 5 ft fencing
to begin at the front of the Dakis house since I only have
approximately 30 ft from the front of my home to the end of my
property.
