Southold Town Board of Appeals MAIN ROAD- STATE ROAD 25 SOUTHOLD, L.I., N.Y. 11g'71 TELEPHONE (516) 765-1809 ACTION OF THE ZONING BOARD OF APPEALS Appeal No. Application TO: 3141 'Dated May 6, 1983 Mr. and Mrs. Doug Constant 555 Village Lane Orient, NY 11957 Mr. Kenneth Stracnan (Builder) Hog Pond Road, Orient, NY 11957 (Public Hearing held 6/23/83) [Appellant(s)] At a Meeting of the Zoning Board of Appeals held on June .23, 1983 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section ~ ] Request for Variance to the Zoning Ordinance Article III , Section 100-31 [ ] Request for The public hearing concerning this application was also held on June 23, 1983. Upon application for DOUG AND KARIN CONSTANT, 555 Village Lane, Orient, NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for permission to construct addition to dwelling with an insuffi- cient rearyard setback, at 555 Village Lane, Orient, NY; County Tax Map Parcel No. 1000-25-2-5.1. The board made the following findings and determination: By this appeal, appellants seek permission to construct a new 4' by 24' addition at the rear of the dwelling, which would leave an insufficient rearyard setback of 21 feet. The present setback of the subject dwelling is 25 feet from the rear property line. Also exist- ing on the premises is an accessory barn structure located south of the dwelling in the rearyard area, approximately one foot from the rear property line. It is the opinion of the board that due to the narrowness of the lot and the location of the dwelling that there is minimal rearyard area; and that the relief requested is reasonable and practical under the circumstances. In considering this appeal, the board determines that the variance request is not substantial; that the circumstances herein are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible to appellant other than a variance; that no adverse effects will be produced on available governmental facilities of any increased population; that the relief requested will be in harmony with and promote the general purposes of zoning; and that the interests of justice will be served by allowing the variance as indicated below. On motion by Mr. Douglass, seconded by Mr. Sawicki, it was RESOLVED, that Appeal No. 3141, application for DOUG AND KARIN CONSTANT for permission to construct addition with an insufficient setback from the rear property line of 21 feet, BE AND HEREBY IS APPROVED AS APPLIED FOR. Vote of the Board: Ayes: Messrs. Goehringer, Doyen, Douglass and Sawicki. (Member Grigonis was absent.) This resolution was unanimously adopted. ) /~.. -~ DATED: June 29, 1983. Dear Mr. Constant: I received a notice dated 6th May, 1983 from the' Board of Appeals, Town of Southold in the matter of your petition to obtain relief from the 37ft, minimum rear yard setback to a plus or minus 21ft. so as to allow you to extend the room in the back of your house which is already over the 37ft. setback. I am writing to you to express my approval of your request. Your renovation of the house over the past few years since you acquired it has greatly improved its visual appeal and has enhanced the aspect of your part .of Village Lane. You .have returned the house to it's old character in keeping with the -Historic Landmark designation of -this part of Orient of which your neighbors are particularly appreciative. rs very s nc`e 1 J J.
