Box 796 Cutchogue, NY 11935 At a Meeting of the Zoning Board of Appeals held on February 25 , 1983 the above appeal was considered, and the action indicated below was taken on your [ ] Request for Variance Due to Lack of Access to Property New York Town Law, Section 280-a [ ] Request for Special Exception under the Zoning Ordinance Article , Section [X] Request for Variance to the Zoning Ordinance Article III , Section 100-31 [ ] Request for The public hearing concerning this matter was held on February 4 , 1983 and February 25 , 1983. Upon application of LAST ASSOCIATES , Box 796 , Cutchogue, NY for a Variance to the Zoning Ordinance , Article III, Section 100-31 for per- mission to construct one-family dwelling with reduced front and rear yard setbacks upon parcel located on the- north side of .Birch Avenue, Southold, NY; County Tax Map Parcel ID No. 1000-77-01-021. The board made the following findings and determination : By this appeal, appellant seeks permission to locate a proposed one-family dwelling on a parcel of land located at the. north side of Birch Avenue, Southold, - and which is more particularly known as Lots 229 and 230 of Goose Bay Estates Subdivision, Map No. 1176 . An area variance is requested to locate the dwelling 35 ' from Birch Avenue and 33 ' from the rear property line. The parcel in question fronts along Birch .Avenue 50 .94 feet and has a depth of 120 feet. The board agrees with the reasoning of applicant in the .type of house chosen and the .positioning of the house. At the hearing, a neighbor, Mr. George Dalton appeared and informed the board that-his water well was situated 32z feet from the applicant' s rear property line and the County Health Department. had proposed a change in the location of the applicant' s well and cesspool areas, if necessary. Mr. Dalton was also concerned about water runoff onto his property which he feels may affect his water. The applicant assures that the vegetation and trees outside the area of construction will not be disturbed. In considering this appeal , the board determines .that the variance . request is not substantial in relation to the requirements of the zoning code; that the circumstances are unique; that by allowing the variance no substantial detriment to adjoining properties will be created; that the difficulty cannot be obviated by a method feasible - for appellant other than a variance; that. the relief requested will be in harmony with and promote the general purposes of zoning; and in view of the manner in which the difficulty arose and in consideration of all the above factors , the interest 'of justice will be served by allowing the variance as indicated below. As a result of a mailina error I did not receive the Notice of the Hearing which i understand was sent out. Additionally, it is my understanding that some of the information submitted to the Board ma_y not be accurate. Specifically, the location of my well point in relation to the location of the proposed dwelling was not properly measured and the effects of the downward slope of the land running from the proposed dwelling to my house have not been considered. Accordingly, I respectfully request that this application be adjourned for one month in order to permit me to have a survey conducted to accurately determine the location of my well point and to determine the effect the proposed dwelling will have on my house because of the slope of the lots. -z- I would also point out that I intend to build a raised deck on my house which may impair the sightlines of the proposed dwelling and I would expect that Last Associates will agree not to object to the building of such a deck and such agreement will include any subsequent owners of the proposed dwelling. Davis DATE: October 29, 1982 RE: GOOSE BAY ESTATES ACCESS ROAD TO LOT NO. 21 COMMENTS: Access to Lot 21 could be made from Cedar Avenue .via Birch Avenug. At present Birch Avenue .is a little used dirt road in poor condition. I would not recommend this access due to the abrupt turn at the intersection, additional necessary grading and poor sight distance for exiting traffic caused by the steep descending grade on Cedar Avenue. I would recommend using Oak Avenue and Hickory Avenue vh ich is presently used for access to Lot 22. Both of these roads in 20 ft. R.O.W.'s are in fairly good condition with widths of from 12 to 14 ft. Me surface is a 1" - course of oil and sand on apparently stable base material. Hickory Avenue teas the oil and sand surface only to the N.W. corner of Lot 22. Access to Lot 21 would have to be improved on two sides of Lot 22 and continued on Birch Avenue to say the center of the frontage at Lot 21. Recommendations for access using Oak Avenue., Hickory Avenue and the westerly section of Birch Avenue: 1. Roadwridth 14 ft. (Necessary clearing has been done). 2. Remove topsoil and loam for 121' where necessary (test holes show 32 " depth on Birch and 3" on Hickory). 3. Replace topsoil excavation with bankrun sand and gravel that contains some loam. 4. Place a compacted surface course of stone blend or equal 3" in depth. 5. Some minor grading may be necessary to smooth out the profile . Emergency vehicles would have to use a driveway at Lot 21 for turning. Road runoff drainage will go to Hickory Avenue and down to Oak Avenue. I do not believe this additional read will cause any drainage problem. Most of the land in this part of the subdivision is wooded and slopes to Oak Avenue. \�1 J Town Hall, 53095 Main Road P.O.
