Box 728 Southold, New York 11971 August 29, 1989 Mrs. Margaret McGwire PO Box 453 Peconic, N.Y. 11958 Re: Application No. 12-3-88-98-3-17 Dear Mrs McGwire: The following action was taken by the Board of Town Trustees during their regular meeting held on August 24; 1989 regarding the above matter: WHEREAS, Edward Diefenbach on behalf of Margaret McGwire applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December ' 15, 1989 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on March 23, 1989 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, ; . WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED that Edward Diefenbach ON BEHALF OF Margaret McGwire BE AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct 221 x 401 addition to existing single family dwelling on property located on property located on Campfire Lane, Peconic, N.Y. Verwayen to construct a private boat dock consinting of fixed elevated (3' above grade of marsh) catwalk, hinged ramp and two floats secured by pilings. RESOLVED to recommend to the Southold Town Trustess approval with stipulations of Wetland Application No. 11-88-113-6-11 for Gerald Wood to cpnstruct a timber dockconsisting of a 4' x 104' fixed elevated (min. 3.5') walk with outer 5' x 36' "L" to west. Inner end of dockwill be approximately in -line with two existing timber pilings and 15' west of them. Prop,soed dock will extend a distance equal to exising adjacent dock to east. The Council recommends approval with a further recommendation that natural plantings in the area to be filled behing the railroad ties to avoid runoff into the creek. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 1-1-89-127-68 of John and Eleanor Bastone to construct a floating dock and landing. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 10-88-123-4-5 of Thomas Palmer to replace a 53' x 3' catwalk and 16' x 8' float and additioanl work to dwelling consisting of a 12' x 37' wood deck to rear of dwelling, 8' x 37' extension and 11' x 22' garage to. front of dwelling and move existing 8.4' x 8.4' shed to west side of lot (further from HWM) . RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 1-3-89-56-5-36 of Mateo Lettunich to reinforce westerly concrete and rock seawall, includein returns and reconstruct easterly rock revetment with additional rocks and filter cloth. The Council recommends approval since the work needs to be done but they would like to go on the record that if the work was a new project they would have recommended disapproval. (to 3' below MLW) from an area 10' in front of bulkhead and use spoil fro backfill, remove existing dock and replace with 3' x 12' hinged ramp and 6' x 16' float secured by (2) 2-pile dolphins. Kujawski, Jr. , President RE: Section 98 , Block 3 , Lot 17 M 365 Campfire Lane, Peconic, New York Dear Mr. Kujawski: This letter is in response to the Board of Trustees hearing on March 23, 1989 regarding Mrs. Margaret McGwire' s request to construct a two story garage including living quarters on the above captioned property. This proposed structure is to include a walkway from the second story to the present house; the walkway to extend out 30 feet plus, east from the proposed two story building and the same distance south to the deck of the present building. As I own the property east and north of the McGwire' s land, I am not too pleased about having my view spoiled any more than it is now. The present house built two years ago commands excellent views in all directions for the McGwires .- The construction is a prefab barn type set on pilings surrounded by decks. This brings the structure of two stories plus an attic, about 10 feet off the ground. To add the proposed walkway and another two story building would not improve the shore line for others. At present the McGwire' s septic field is along my property line east, from the beach north. I was under the impression the original plan called for it to be west of the house where the driveway is now. My property that adjoins the McGwires has 130 ' of beach frontage and extends the entire north-south boundary of approximately 500 ' and 67 ' on the north. I have owned this property since 1942, but have kept it open and all have enjoyed the bay, however, this does not preclude its possible sale or building at sometime. At present I am having a water run-off problem because of the amount of fill that was built up around the pilings of the McGwire' s .home. I contacted the building department regarding this and understood the land was to be graded and seeded to prevent this prior to a Certificate of Occupancy being issued. As of a few weeks ago, the run-off problem still existed; the McGwire house has been occupied for two years. I feel I owe it to my family and the other residents to maintain the proper custodianship of our beach. 0 2 . RESIDENTIAL USE. The lots shown on said Map shall be used for residential purposes and for no other purposes . No structure, fence or wall shall be erected, placed or altered on any lot until f the construction plans and specifications therefor, and a plan showing the location of the structure, fence or wall on the lot on which it is to be erected, shall have been approved in writing by Abelson, or his heirs and assigns, with- respect to: quality of workmanship and materials; .harmony of external design with dwellings in Arrowhead Cove; landscaping; location of structure, fence or wall on lot; topography and grade elevation; preserva- tion of trees and other natural features of the lot; and any other matter or thing touching" or concerning property values at Arrowhead Cove or the harmonious and beneficial development of Arrowhead Cove. It is intended that all structures, fences and walls at Arrowhead Cove shall be of high quality design and workmanship. 4. TEMPORARY STRUCTURES . No trailer, tent, shack, garage, barn, outbuilding or structure of a temporary character shall be used at any time as a resi- dence either temporarily or permanently. 5. NO ANIMALS.' No animals, live stock or poultry of any kind shall be raised, bred or kept at Arrowhead Cove except that dogs, cats and other household pets may be kept provided they are not kept, bred or maintained for any commercial purpose . 6. NO TRASH. No portion of any lot shall be used or maintained as a dumping. areafbr garbage, rubbish or other waste . All garbage, rubbish and other waste f - I ' 2 - shall be kept in sanitary containers . There shall be no incinerators or other disposition of garbage, rubbish or r I other waste on said lots . 7. TREES . There shall be no destruction of trees on any lot, except as. may be required for the I erection of a structure approved pursuant to paragraph _ 3 hereof and for proper landscaping of the lot on which such structure is to be located, or as may be required by reason of the rotting of trees or by reason of principles of good tree management . 8. BOATS . No boats or boat trailers shall be I stored on any lot where the same shall be visible from Arrowhead Lane or Campfire Lane . There shall be no launching of trailer-borne boats from the communal beach area shown on said Map and marked "Beach" . 9. CONTRIBUTIONS FOR TAXES AND MAINTENANCE OF ROADS AND BEACH. For so long after the date hereof as Abelson, or his heirs and assigns, shall pay taxes on or otherwise care for Arrowhead Lane -and/or Campfire Lane, as shown on said Map, and/or the communal beach area shown on said Map and marked "Beach", the owner or owners from time to time of each lot shown on said Map shall pay to Abelson, or his heirs and assigns, such owner or owners ' proportionate share, of such taxes and other costs of caring for said Lanes- and beach area, including without limitation costs of premiums for liability insurance . If at any time said Lanes and beach area: are not separately j assessed for tax purposes, but are included in the assess- ment of other premises, then appropriate apportionment of such assessment.., and the taxes computed thereon, shall be made for the purposes of this paragraph 9. Each lot owner's j i I proportionate share of such taxes and other costs shall i be a fraction the numerator of which shall be the number ! 4 of lot or lots owned by such owner and the denominator of i which shall be 40. Appropriate apportionment shall be made with respect to portions of lots . Such amounts may be collected by Abelson, or his heirs and assigns, from time to time as such taxes and other costs are incurred, at such intervals as Abelson, his heirs and assigns, shall deem, reasonable . Abelson, his heirs and assigns, shall have a charge or lien upon each lot, prior to all other liens except taxes and municipal assessments, for the amount which is payable hereunder by the owner or owners of such lot, together with interest, until the same shall be paid or satisfied, enforceable by appropriate remedy in equity againstsuch lot, in addition to and concurrent with any proper remedy at law, for the recovery of such amount and interest. 10. RIGHTS OF WAY. The owner or owners of each lot shown on said Map shall have a right of way, in common with Abelson, his heirs and assigns, over Arrowhead Lane and Campfire Lane, as shown on said Map, for passage between their respective lots, Indian Neck Road and the above mentioned communal beach area shown on said Map and marked "Beach", and shall also have the right, in common with Abelson, his heirs and assigns, to use said communal beach area shown on said Map and marked "Beach" , for the purposes of surf bathing. No vehicles shall be parked on the "turnaround" portions of said Lanes or on any other . portions of said Lanes . 11. BOAT BASIN. Notwithstanding the fact that said Map designates thereon a boat basin, Abelson shall not be deemed to have any obligation to construct a boat fI basin or any other improvements, and no person shall, " f by reason of the filing or existence of said Map or the filing or existence of this instrument, be deemed to have i any rights in or to the premises shown on said Map marked "Boat Basin (To be developed)" or the area marked "To be divided for use by individual lot owners only" or the area marked "Right of Way" or the area marked "15' Right of Way", and the restrictions and covenants set forth in this instrument shall not be deemed to apply to said boat basin area or any of the other areas hereinabove referred to in this sentence . It is Abelson's intention, if and when a boat basin is erected, to make the same available on a preferential basis to owners of lots shown on said Map upon payment of such rental and other charges as shall from time to time be in effect, but no lot owner shall be deemed to have any vested rights with regard thereto. Notwithstanding the legend on said Map reading "To be divided for use by individual lot owners only", Abelson, and his heirs and assigns, shall have the right to sell or lease the boat basin area and the other areas herein- above referred to in this paragraph 11 to a person or persons who do not own lots at Arrowhead Cove and may permit such person or persons to pass over Arrowhead Lane .and Campfire Lane . 12 . ASSIGNMENT , The restrictions and covenants hereinabove set forth shall run with the land, subject to the provisions hereinafter set forth in this paragraph 12.
