The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees• of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:.
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.H. Weaken or undermine the lateral support of other lands in the vicinity.
I. Otherwise adversely affect, the health, safety and general welfare of the people of the town.

Dear Mr. Mebus:
The following action was taken by the Board of Trustees on
May 29, 1986 regarding your Wetland Application.
Moved by Trustee Smith seconded by Trustee Goubeaud
WHEREAS, Charles Mebus applied to the Southold Town Trustees for
a permit under the provisions of thw Wetland Ordinance of the
Town of Southold, application dated March 5, 1986, and
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on May 29, 1986 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area; and
WHEREAS, the Board considered all testimony and documentation
submitted concerning this application; and it is noted for the
record that there has been no public opposition; and
WHEREAS the Board has determined that the project as proposed will
not affect the health, safety, and general welfare of the people
of the Town,
NOW, THEREFORE, BE IT
RESOLVED, that Charles A. Mebus be granted permission under the
provisions of the Wetland Ordinance of the Town of Southold, New
York to remove approximately 30 cu. yds . of sand and dirt deposited
in the creek from the storm drain. This permit will expire on
May 29, 1987 if work has not commenced by same. The Trustees are
to be notified upon completion of the work.
A $5. 00 inspection fee is now due and payable. . Upon remittance
your permit will be forwarded by mail.

Dear Mr. Kujawski:
In reference to your letter of June 12, 1989, I find it very difficult to
understand that you and Henry Smith believe that there is not a problem
with road runoff into Jockey Creek by my bulkhead. I can document the
depth the water under the pipe after dredging a year ago this past
spring, and tell you the present depth. All you have to do I look at the
creek and the mud on the supports for the bulkhead after a rain.
Also, look at the pile of dirt and sand next to the runoff entrance into
the sump to see that amount of dirt and silt that comes down the road in
runoff. The pile of dirt and sand is what I clean out of the runoff
entrance to maximize the flow of water off of the road.
I am particularly concerned after reading in last Thursday's paper that
permits would no longer be given for dredging Jockey Creek. The Town
should correct their problems before making such a decision.
I would hope that Ray Jacobs is aware of the extent of the problem on
Wells Avenue, but if not I shall gladly visit with him about the runoff.
Simply enlarging the sump will not cure the problem, for the way the road
toward Oaklawn slopes, a large percentage of the water comes down on my
side of the street.

Thank you for your letter of August 13, 1989. I have relayed your
letter to Ray Jacobs. We do regard the removal of material from the
discharge pipe as a highway department problem caused by road drainage.
It is true that Henry Smith and I did not feel, several months ago,
that a large quantity of silt was present. The situation may be- different
now but Ray Jacobs would be responsible for correcting this.
The dredging moratorium you mentioned applies only to new dredging
projects. Maintenance dredging projects are always permitted.

In regard to the second request in my letter of January 7, 1989 and
letter of February 6,1989 concerning removal the sand and silt that has
accumulated by the pipe outlet since since I had the dredging done one
year ago. When the dredging was completed last spring, there was 3 feet
of water at low tide below the pipe outlet; now there is sand. Last year
the Town Highway Department dumped road sweeping in eroded areas across
the street. This filled the ditches, but half of it ended up in the creek
_ by my dock. This year even more sand was dumped across the street.
Several weeks ago, on a week day two men stopped by the house and asked
for me. I was at work. They did not state what they wanted, went down by
the bulkhead, and then left.
Until the Town gets around to correcting the runoff problem into the
creek, the least it could do would be to remove the sand the runoff is
depositing by the outlet pipe. The State Highway Department assumes the
responsibility of doing this for the silting of one of the local marinas
by runoff from Rt 25. It is not right that I have to assume the cost for
a Town problem. ,
I would appreciate having your,. contact the Town Highway Department about
removing this material. The area is bulkheaded, so it can be done with a
backhoe.

dept. to use that drain that you have, as an overflow of an extreme rain. We
would rather see the rain go into the sump, for environmental reasons first,
then leach out that way throuth the storm drain and then into the creek.
Trustee Krupski: How do you intend to do this?
Mr. Mebus: By backhoe.

interest in controlling polution of the creeks by runoff. A storm drain
pipe runs from wells Ave. through my property and enters the end of the
spur of Jockey Creek. During moderated and heavy rains the spur of the
creek resembles a big mud puddle. over the years so much sand from the
road, silt from near by fields and dirt from storm damage has entered the
creek that the area adjacent to the bulkhead where there used to be at
least 3'of water at low tide is now exposed bottom. This problem could be
easily corrected for opposite the storm drains which run to the creek
there is a Town sump. The sump could be enlarged and the storm drains run
to the sump. To prevent flooding of the road when there is a lot of rain
an overflow could be run to the creek using the existing pipe. If this
were done, most the water would go in the sump and when there is heavy

RESOLUTION MARCH 27, 1986
RESOLVED that the Southold Town Trustees declare itself lead
- agency in regard to the State Environmental Quality Review
Act in the matter of the application of Charles A. Mebus
for a Wetland Permit on certain property located
at 2145 Wells Avenue, Southold.

Gentlemen:
A storm drain pipe runs from Wells Ave. through my property and enters the
end of the spur of Jockey Creek through the bulkhead. Over the years so
much sand from the road, silt from near by fields and dirt from storm
damage has entered the creek that the area adjacent to the bulkhead where
there used to be at least 31of water at low tide is now exposed bottom.
The storm pipe where it passes through the bulkhead has corroded. During a
heavy rainstorm last August the combination of a hole in the corroded pipe
and overflow from the road resulted in a large washout behind the
bulkhead; this dirt also went into the creek. The Town Superintendent and
the Highway Department were notified of this problem several times over
the past year; the Highway Department has said that they will repair the
pipe. I have also given them photographs of the silting of the creek and
have asked if they would remove the sand and silt for I beleive that this
silting is a Town responsibility. The enclosed application for dredging is
to remove the sand and dirt described above.

below has determined that the project will not have a significant
effect to the environment.

DESCRIPTION OF ACTION: Appellant „proposes to remove sand and silt
from an area approximately 30 ' x 4 ' in Jockey Creek, Southold which
accumulated from a storm drain pipe.
CONDITIONAL ENVIRONMENTAL' DECLARATION: Subject to the comments
