TERMS and CONDITIONS

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing: Trustee Permit must ne prominently displayed on effected
premises during period. of work.
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for .a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances warrant, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
G. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee of the completion of the work auth-
orized.
9. That the Permittee will obtain all other permits and consents that may be required sup.
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Haje:
The following action was taken by the Board of Town Trustees
during their regular meeting held on April 27, 1989 regarding the
above matter:
WHEREAS, En Consultants on behalf of David Merz applied to the .
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated May 19,
1988 , and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on April 27, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
-the town,
NOW, THEREFORE BE IT
RESOLVED that En Consultants ON BEHALF OF David Merz BE AND HEREBY
IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: construct 150
linear feet of stone revetment along Spring High Water Line of
Sterling Creek, and construct wooden deck on one story house.
Property located at Robinson Road, Greenport, N.Y.

This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please take notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
Permit will be issued upon payment of $10. 00 inspection fee.

SOUTHOLD TOWN
CONSERVATION ADVISORY COUNCIL
The following recommendations were made at the regular meeting
of the Southold Town Conservation Advisory Council held Tuesday,
August 23 , 1988.
RESOLVED-t-o recommend to the Southold Town Trustees disapproval
of the Wetland 'Application No. 634 of David Merz to construct
a 150± 1. f, stone revetment ( 50-100 l.b. ) generally above SHW
and extending from'.top of bank seaward 6± ' and construction of
an open wood deck on south side of existing house . (Maximum
dimensions of deck will be 43 ' 6" x 16 ' 6" . The Council recommends
disapproval because it feels the area would be better served
with a bulkhead. A stone revetment would cause more damage.
RESOLVED to recommend to the Southold Town Trustees disapproval
of Wetland Application No. 636 of Andrew and Bernice Lettieri
to build an elevated catwalk over fringe of marsh and install
an offshore mooring pipe. The Council recommends disapproval
because it feels the proposed project is not practical. There
is not enough space and therefore would create a dangerous
situation.
RESOLVED to recommend to the Southold Town trustees disapproval
of Wetland Application No. 638 of Dolores Holman to construct
two 30 ' timber groins near middle and east side of bulkheaded
propertyThe Council recommends disapproval because it feels the
project does not represent the best engineering. The space be-
tween groins should be at least two and a half to three times
the length of the groin and filled with sand. The Council suggests
only one groin may perform better. The groin should be of a
low profile and fill with sand.
The following applications were tabled:
No. 637 of Mr. and Mrs. Lambert Javelera. The CAC has been in-
formed that the application is due to be resubmitted. The CAC
will make an recommendation after it has reviewed the new material.
No. 639 of Frank and Antoinette Notaro. The application shows
no access to the dock and the CAC cannot make a recommendation
until that information is supplied.
No. .640 of the Gardiners Bay Estate Home Owners Association,
Inc. The CAC needs further information from the applicant
showing the bulkhead and catwalk.
Council Chairman John Holzapfel will be in attendance at the
Thursday, August 25 , 1988 Trustees ' meeting and will be available
to answer any questions you may have concerning these recommend-
ations . Please feel free to contact me if I may be of any assist-
ance.

DESCRIPTION OF AUTHORIZED ACTIVITY
Construct 150± linear feet of stone revetment along the Spring High Water Line of
Sterling Creek and construct an irre u larly shaped wood deck attached to an existing
one story house in accordance with attached plans entitled "Proposed Stone Revetment
for David Merz" sheet 1 of 1 dated March 13 1989.
GENERAL CONDITIONS
By acceptance of this permit,the permittee agrees that the permit is contingent upon strict compli-
ance with the ECL,all applicable regulations and the conditions specified herein or attached hereto.
1. The permittee shall file in the office of the appropriate regional permit administrator,or other office designated in the special conditions,a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify him/her promptly in writing of the completion of the work.
2. The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL§71-0301 and SAPA§401(3).
3. The permittee has accepted expressly,by the execution of the application,the full legal responsibility for all damages,direct or indirect,of whatever nature,and by whomever
suffered,arising out of the project described herein and has agreed to indemnify and save harmless the State from suits,actions,damages and costs of every name and descrip-
tion resulting from the said project.
4. The Department reserves the right to modify, suspend or revoke this permit at any time after due notice,and, if requested, hold a hearing when:
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found;or
b) the permit was obtained by misrepresentation or failure to disclose relevent facts;or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
5. The permittee is responsible for keeping the permit active by submitting a renewal application,including any forms,fees or supplemental information which may be required
by the Department, no later than 30 days(180 days for SPDES or Solid or Hazarduous Waste Management permits)prior to the expiration date.
6. This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights, title or interest in real or personal property held or vested in a person not a party to the permit.
7. The permittee is responsible for obtaining any other permits, approvals, lands• easements and rights-of-way which may be required for this project
8. Issuance of this permit by the Department does not,unless expressly provided for,modify supersede or rescind an order on consent or determination by the Commissioner

The Bureau of Marine Habitat Protection has .made a review .of pour proposal
and has the following comments:

(2) For a variance the applicant would need to submit .the following:
(a) Request the variance sought.
(b) State the minimum variance necessary to alleviate .the
allegedidifficulty.
(c) Facts to support the granting of a variance.
(3) A preferred alternative would be to modify the project to
limit the new decking and patio area to westerly part of lot
no closer than existing house and patio to wetlands edge. Please
consider and discuss this alternative. If such modified plans are

1,/(4) It is recommended that intertidal marsh vegetation be planted
seaward of the proposed rip rap to stabilize area and benefit
