Upon application of JANET A. .DAVIS, Box 885, Cutchogue, NY for a Variance to the Zoning Ordinance, Article XI, Section 100-118D for per- mission to reinstate. nonconforming use as an antique shop and residential use (apartment) in this A-Residential Zone. Location of Property: 45395 Main Road, • Southold, NY; County Tax Map Parcel No. 1000-075-02- 011. (Owner of Property: Nellie M. Williams) The board made the following findings and .determination: By this appeal , appellant seeks relief from Article XI, Section 100-118D of the Zoning- Code for permission to reinstate use as a busi- ness and residence,. which has been discontinued for more than two years. The premises, in question is a corner lot as defined by Section 100-34 of the code and is zoned "A-Residential and Agricultural. " . Existing on the premises is a principal two-story building containing a total area of 1527 square feet (and within which the antique-shop use and apartment use are requested) and an accessory storage building located in the rear yard area which contains an area of 440 square feet. The lot in question contains an area of 15,500 square feet, as shown on survey marked "Exhibit A. " Appellant' s request. is for a dual use of the premises , to wit, antique shop and -apartment, which is- not permitted by the code. It is the opinion of the board that the land in question can yield a reasonable return if only used for a purpose allowed in that zone; however the reinstatement of the use as existed for many years prior to its discontinuance for more than two years would not alter the essential character of the locality. Furthermore, the board does not feel that the granting of the antique shop in the 357-square-foot area and dwelling unit use for the owner in the. area depicted on "Exhibit A*, " both in the principal building, would be a detriment to adjoining properties. On motion by Mr. Doyen, seconded by Mr. Grigonis , it was RESOLVED, that Appeal No. 3077, application of JANET A. DAVIS for permission to reinstate antique-shop and apartment use within the principal building, BE AND HEREBY IS APPROVED SUBJECT TO THE ('CONTINUED ON PAGE TWO) DATED: March 9 , 1983. Any future construction shall require an application to and approval by the Board of Appeals; 6 . The structure depicted "barn" on Exhibit A shall be used only for storage (no retail sales or living area) ; . 7. Reeve March 18, 1958 'SL)fafi7 Henry Moisa Alfred @rebe A special meeting of the Planning Board of Southold Town was held at the Town Clerk's Office, Southold, N. Y., at 7:30 P. M., March 18, 1958. There were present: Messrs. John Wickham, Chairman; Harold R. Reeve; Henry F. Moisa and Howard M. Terry, Building Inspector. Considered and discussed were: Application of Ellsworth and Winifred Grathwohl for a change of zone from "All to "B" district of the Williams Estate property at Southold, N. Y., as described in the formal application. 7 On motion by Mr. Reeve and seconded b Yx y . Moisa, and carried, the Planning Board recommends to the Tovm Board this change of zone and also recommend to the Town Board including the Store property of Nellie Williams of which adjoins this parcel, in the "B" district. Application of Charles B. Sage and B. S. Garde for a change of zone from "A" `� to B district at Arshamomapue, as described in the formal application, East side of Main Road 200 feet deep from the railroad property.on the North to the Sea Shell property (Carrol Sledzieski) on the South. On motion by Mr. Reeve, seconded by Mr. Moisa, and carried, it was recommended to the Town Board that this change of zone be made. Application of Alexander and Frederick Koke to establish an Open Development Area on their property at Bay View, Southold, N.Y., as per map of OttoWe VanTuyl, dated 2/20/58, On motion by Mr. Moisa, seconded by Mr. Reeve, and carried, the Planning Board recommended the following to the Town Board: Koke Drive South be widened ` to 50 feet by moving Lot 8 back 20 feet; reducing Lot 7 to 100 feet frontage on Cory Creek Road and taking 20 feet off Lots 10 and 11 on North side to Clemens lot line. On the South Side, beginning at A. Koke lot, taking 20. feet off the South side to Koke Drive East and 20 feet on the East side to widen Koke Drive East to 50 feet to the creek. Also further recommended that an attempt be made to secure a release-of 20 feet from the Clemens lot to complete a 50 foot right of way. S2. MISS NELLIE WILLIAMS' STORE I Alvin Squires' 1856 Moved c. 1875, Became Store of William A. Williams, (?Miss Nellie Williams' Store, Main Road, half-way between - ! Southold and Peconic.) Miss Nellie Williams' Store began its history as Alvin Squires' store in 1856 when it stood first as a part of the Squires homestead about opposite Hermitage (Peconic) Lane on the Main Road. Alvin Squires came from Good Ground to Hermirage (Peconic) in 1856 with his family and his second wife, Mary Jennings. He bought the Jennings farm lands of 100 acres which ran to Hu'tchinson's Creek, built a large home and had a ,tore by the road side. He died in 1874. His son, James, inherited the farm; eventually purchased by George H. Wells at a later date. The house was destroyed by fire. WillIiam A. Williams, born 1845 in New York, was in Southold as a young boy, went back to the city but returned in 1874 with his wife; Sarah Anna Booth, and first child, i Elnera. He bought a house and 10 acre farm lialf-way to Peconic and soon purchased and moved the Alvin Squires' i store: to its present site west of his home. His neighbors pre- dicted he "would not make a nickle on the store" in that location, but he did! Mr. Williams was thrifty and lie became j one of Southold's leading business men of the village. Those were the days when eggs sold for 12c. per dor., an([' beef, 10c. per pound. The big, red coffee mill ground coffee ' to order and there was the barrel of molasses not too far from the barrel of kerosene; with hardware, harness, a cobbler shop (Gus Homrriel) at the rear of the store. 1 Eleven children were raised in the Williams home, William A.'s brother Henry and his brother Lewis cacti had a home across the road. This was a Williams family center.
