Box 728 Southold, New York 11971 Dear President Krupski: We are the attorneys for Donald Brennan who intends to sell the above-captioned premises. In connection with the sale, he is required to provide a Certificate of Compliance or other evidence that none is required for the bulkhead on the premises. In or about 1987, our client had to obtain a waiver from the Board of Trustees to cover a twenty inch (20") high timber curb which was constructed landward of the existing bulkhead. By letter dated July 29, 1987, copy enclosed, the Board of Trustees indicated that at a regular meeting held two days earlier, the Trustees adopted a resolution which granted a waiver so as to permit the construction and maintenance of the timber curb landward of the existing bulkhead on the premises. We understand that in order to obtain the waiver, our client presented documentation which verified that the timber bulkhead was pre-existing and replaced, due to storm damage, a concrete sea wall that had been in existence for many years. After checking with the Board of Trustees' office, we were told that there is no record or permit on the files for the timber bulkhead which is shown on the copy of the Roderick Van Tuyl survey last dated October 16, 1984, a copy of which is also enclosed. It should be noted that in 1987 members of the Board of Trustees personally viewed and were familiar with the premises as stated in the resolution. Humes & Wagner Page 2. In view of the fact that the Trustees were familiar with the existence of the bulkhead in 1987 and appeared to have no objection to its existence, we respectfully request that the resolution, adopted on July 27, 1987, be amended to cover the bulkhead as well as the timber curb because the bulkhead was found to be pre-existing in 1987. We have been advised by your very courteous staff that the Board has a procedure to obtain a "grandfather" permit for pre- existing structures, but that the procedure can sometimes take several months which may unduly delay our sale. We would appreciate you advising us if it is possible to amend the former waiver to expedite matters. Our client is willing to pay any fees required for amending the 1989 waiver.
