revocation of this Permit by resolution of the said Board.
6. That there will be no unreasonable interference with navigation as a result of the work
herein authorized. ==
T. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
8. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
. of Southold

Dear .Mr. Fitzgerald:
The following action was "taken by the Board of Town Trustees
during their regular meeting held on November 17, 1988 regarding the
above matter: -
WHEREAS, Proper-T Services on behalf of Robert E. Mitchell applied
to the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
August 3, 1988 and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on November 17, 1988, at which time all
interested persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that Proper-T Services on behalf of Robert E. Mitchell BE
AND HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct 24 ' X 4 ' walkway, 12' x 3 ' hinged ramp, 16 ' x 16 ' floating
dock, install two-2 pile dolphins to secure floating dock, with the
stipulation that walkway be elevated above grade level. This permit
will expire two years from the date it is signed if work has not
commenced by said date. There are two inspections required and the
Trustees are to be notified upon the completion of the work.
Prior to the issuance of said permit by the Clerk,- the applicant
shall file with the Clerk a certificate that he has public liability,
i
insurance policies insuring against any liability which may arise in
the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as the name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
The following fees are now due and payable:
$264. 00 permit fees
$10. 00 Wetland Inspection Fee
Total $274.00

CONSERVATION ADVISORY COUNCIL
September 26, 1988
The following recommendations were made by the Southold Town Con-
servation Advisory Council at its regular meeting on Tuesday,
September 20, 1988.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 641 of Laughing Waters Property Owners Association
to reconstruct in kind/in place approximately 227r' of deteriorated timber
bulkhead. An area 3' seaward of said structure shall be dredge to
a depth of 3' at MLW. The resultant spoil, approximately 50 c.y.
of sand shall be utilized as backfill for the new bulkhead.
RESOLVED to recommend to the Southold Town Trustees approval with
stipulation of Wetland Application No. 642 of Paul Ferdenzi to construct
a walkway 20' x4', hinged ramp 12' x 4' and folating dock 16' x 6';
install two 8" piles to secure floating dock. Approval is with the stipulation
that the grass between the'-lawn ,and water be disturbed as little as possible.
Tabled Wetland Application No. 643 of Nicholas Theoharides. The
CAC wishes to await the answers to questions posed by the NYS Department
of State.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 644 of Thomas E. Boyle to repair existing concrete
wall by reinforcing with rip-rap in fornt of and behind existing wall
in an attempt to prevent collapse. Truck in fill from an upland source
to place behind existing wall.
Leeton Drive, Southold.
RESOLVED to recommend to the Southold Town Trustees approval of
Wetland Application No. 645 of Thomas E. Boyle to construct a rock
bulkhead, approximately 901.
Leeton Drive, Southold.
RESOLVED -to -recommend .ppto_the =Southold--Town Trustees approval with
`stipulation-=of Wetland Alication No. 646 of. Robert. E. Mitchell to construct
a walkway 12' x 41; and floating dock-4 6-1 -x -6_'_; -install two -2-piie dolphins
to secure floating dock. CAC approvals with the stipulation that the-
walkway be elevated 4' above grade of marsh.
Oakwood Drive, Southold.
Tabled Wetland Application No. 647 of Kenneth Rock. The CAC needs
the response to the questions listed on the DEC sheet.

RESOLVED to recommend to the. Southold Town Trustees approval of
Wetland Application No. 648 of Harold Knight to constaruct a 16' angled
bulkhead return on north side of porperty and backfill with 7± c.y.
of clean loam to be trucked in from an upland source. Return is needed
to prevent further loss of backfill from existing damaged bulkhead.
Calves Neck Road, Southold.
RESOLVED to recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 649 of Alfred Nadel to approve
completed project. Construct 127± I.f. of timber bulkhead above mean
high water to connect to existing adjacent bulkheads 11' from corner
of westerly, 6' from corner of easterly and backfill with 50 c.y. of
clean upland fill. Construct timber pier, 4' x, 181 catwalk, minimum
of 3' above grade, 4' x 12' hinged ramp, 6' x 16' float anchored by
two piles. Approval is with the stipulation that catwalk be elevated
the standard 4' above grade of marsh and that runoff from roof and
lawn be contained on property (suggest use of dry wells, etc.)
Robinson Road, Southold.
RESOLVED to. recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 658 of Port of Egypt Enterprises,
Inc. to erect a 25,440 square foot boat storage building. The stipulations
would be:
1 . Use a pervious driveway surface.
2. Suitable dry well system for roof runoff.
3. Add pumpout station.

The following action was taken by the Board of Town Trustees
during their regular meeting held on November 17, 1988 regarding the
above matter:
WHEREAS, Proper-T Services on behalf of Robert E. Mitchell applied
to the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
August 3 , 1988 and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on November 17, 1988, at which time all
interested persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation

will expire two ears from the date it is signed if work has not
commenced by s d date. The are two inspections required and the
Trustees are be notified up n the completion of the work.
Prior to the ssuance of said p rmit by the Clerk, the applicant
shall file th the Clerk a cert' ficate that he has public liability
insurance policies insuring against any liability which may arise in
the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as the name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.

1. The time limit for completing the work authorized ends on
24 June 1990 If you find that you need

2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi-
tions of this permit. You are not relieved of this requirement if you abandon the permitted activity, although you may make
a good faith transfer to a third party in compliance with General Condition 4 below. Should you wish to cease to maintain
the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of
this permit from this office,which may require restoration of the area.
3. If you discover any previously unknown historic or archeological remains while accomplishing the activity authorized by
this permit, you must immediately notify this office of what you have found. We will initiate the Federal and state coordina-
tion required to determine if the remains warrant a recovery effort or if the site is eligible for listing in the National Register
of Historic Places.

By acceptance of this permit,the permittee agrees that the permit is contingent upon strict compli-
ance with the ECL,all applicable regulations and the conditions specified herein or attached hereto.
1. The permittee shall f ile in the office of the appropriate regional permit administrator,or other office designate f in the special conditions,a notice of intention to commence
work at least 48 hours in advance of the time of commencement and shall also notify hint►her promptly in writing of the completion of the work.
2. The permitted work shall be subject to inspection by an authorized representative of the Department of Environmental Conservation which may order the work suspended if
the public interest so requires pursuant to ECL§71-0301 and SAPA§401(3)
3. The permittee has accepted expressly,by the execution of the application,the full legal responsibility for all damages,direct or indirect.of whatever natum and by whorrsever
suffered,arising out of the project described herein and has agreed to indemnify and save harmless the State from suits,actions,damages and costs of every name and descrip-
tion resulting from the said project.
4. The Department reserves the right to modify, suspend or revoke this permit at any time after due notice,and, if requested,hold a hearing when.
a) the scope of the project is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations are found;or
b) the permit was obtained by misrepresentation or failure to disclose relevent facts;or
c) newly discovered information or significant physical changes are discovered since the permit was issued.
5. The permittee is responsible for keeping the permit active by submitting a renewal application,including any fortes,fees or supplemental information which may be required
by the Department, no later than 30 days(180 days for SPDES or Solid or Hazarduous Waste Management permits)prior to the expiration date.
6. This permit shall not be construed as conveying to the applicant any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the
permitted work or as authorizing the impairment of any rights,title or interest in real or personal property held or vested in a person not a party to the permit

SUPPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all permits :
A. If any of the permit conditions are unclear , the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
B. A copy of this permit or approval and supplementary conditions shall
be available at the project site whenever authorized work is in
progress.
C. The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work .
D. At least 48 hours prior to commencement of. the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit . Within one week of completion of the
permitted work , the bottom portion of that form shall also be com-
pleted and returned.
E. For projects involving activities to be accomplished over a period of
more than one year , the permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to the commencement
of resumption of work each year .
F. If project. design modifications take place after permit issuance, t'he
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior to undertaking any such modi-
fications . The permittee is advised that substantial modification
may require submission of a new application for permit .
G . All necessary precautions shall be taken to preclude contamination of
any wetlands or waterway by suspended solids, sediment , fuels ,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or
any other environmentally deleterious materials associated with the
project work .
H. Any failure to comply precisely with all of the terms and conditions
of this permit , unless authorized in writing, shall be treated as a
violation of the Environmental Conservation Law.
I . The permittee is advised to obtain any permits or approvals that may
be required from the U. S. Department of Army Corps of Engineers, NY
District , 26 Federal Plaza, New York , NY 10278, (Attention: Regulatory
Functions Branch ) , prior to commencement of work authorized herein.

In accordance with the suggestion to the owner by an inspector
from your agency on August 25, 1988, the proposed walkway has
been extended 12 ' in the landward direction in order to pro-
vide additional protection to wetlands vegetation in the area
of the project site.
This change is reflected in the revised drawings "PROJECT
PLAN" and "PLAN AND SECTION VIEWS" , both dated as revised
August 30, 1988, which are enclosed and should be made part of
the original application.
