Dear Mr. Fitzgerald,
The following action was taken by. the Board of Town Trustees
during its regular meeting held on March 24, 1994 regarding the
above matter:
WHEREAS, WILLIAM T. MOLLER applied to the Southold Town
Trustees fora permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated, Feb. 14,
1993 , and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory-Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on March 24, 1994 at which time all
interested persons were given. an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
William T. Moller to construct a 100' X 4' walkway, a 16' X 4'
hinged ramp, a 20 ' X 6 ' floating dock, 2 single spiles and one
2-pile dolphin to secure dock. Located 2530 Vanston Road,
Cutchogue.
Permit will expire two years from the date it is signed.. Fees
must be paid, if applicable, and permit issued within six
months of the date of this notification. Two inspections are
required and the Trustees are to be notified upon completion of
said project.
Permit will be issued upon payment of the following fees for
work to be done below Mean High Water Mark:
Fees: catwalk: 85 ' X 4" = 340' X $3 .00 = $1,020
ramp: 16' X 4' = 64' X $3.00 = $ 192
float: . 20' X 6 ' = 120 ' X $3 .00 = $ 360

RESOLVED to recommend to the Southold Town Board of Trustees
APPROVAL WITH STIPULATIONS of the Wetland Application of
DANIEL B. LYONS 90-4-22 to install 20' x 6' floating dock with
necessary ramp and stationary platform required by law to pass over
protected vegetation. Two (2) pilings to hold dock in place.
The Council recommends approval with the stipulation that the
project does not impede the navigation of others. The CAC suggests
the applicant plant the exposed bank with spartina alterniflora or
spartina patens.

above grade supporting Spartina alterniflora) . 4' x 4' wide wood
steps will be attached to landward end to attain 4' elevation and a
4' wide ladder will be located at seaward end of catwalk.

structure shall be constructed 3' over grade of marsh. Original dock
constructed prior to 1968.

Request for Additional Information
Dear Mr. Fitzgerald:
Pursuant to 15 CFR 930.58, the following data and information is necessary to enable the
Department of State to adequately assess the coastal zone effects of this proposed project.
Please provide a response to the following questions and requests concerning the proposed
133 foot docking facility within State designated shoals/mudflats tidal wetland and
Cutchogue Harbor State Significant Coastal Fish & Wildlife Habitat:
1) The proposed project site is located immediately east of and across Horseshoe Cove from
Meadow Beach, an important habitat for shorebird species that are federally listed as
threatened and listed by New York State as endangered. The project site is also located
within a State designated habitat, as referenced above. Our information indicates that the
large majority of residents in your area moor their boats at marinas or offshore of their
properties. Construction of the proposed structure in the area of concern, an area with
minimal previous disturbance from waterfront development, would contribute to the loss of
a productive area for fish and wildlife resources. Please provide an evaluation of alternatives
that would satisfy your stated purpose of private recreation;
2) Pedestrian access along the beach would be interrupted by the proposed catwalk/dock.
How would such impairment to public access along the intertidal area be mitigated?
3)The proposed structure would impede movement within the shoals/mudflats tidal wetland
for the purpose of shellfishing and other public enjoyment. How would such impairment to
public access within the tidal wetland area be mitigated?
4) Provide a depth survey, specifying depths at mean low water at the project site from the
line of low water to the offshore end of the proposed facility;
5) Indicate on a copy of your site location map the locations.of the,nearest similar existing
structures to that proposed and specify the lengths. Photos of the complete structures, taken
from the proposed project site, are also needed. Please be advised that factors unique to
.structures referenced in the application;'- nclu-ding;date of permit and placement, site
conditions such as depths, sizes and locations are relevant information if the structures are
to be referenced as indicative of existing,waterfront character and use. Our information
indicates that the intertidal and near offshore 'areas,in_question are primarily undeveloped
and pristine;
6) Specify the owner of the potentially affected tidal wetlands bottom. Is it owned by the
State or by the Town of Southold?
Pursuant to 15 CFR 930.60(a), the review of your consistency certification will begin after
we receive and determine that the necessary data and information is adequate to assess
coastal zone effects.
Any additional information which you believe will facilitate our consistency review of this
project would be appreciated.
A copy of this letter has been sent to the U.S. Army Corps of Engineers.

the following activity:

ACTIVITY: 'construct. a ,4. foot .by 100 foot pier, a 4 foot. by
16. foot hinged ramp, and a 6 foot by 20 foot float
to be secured .to two pilings and one 2-pile
dolphin. : The ,purpose of this project is to
provide access to the -applicant's recreational
vessel.
WATERWAY: Horseshoe Cove, Great Peconic Bay
LOCATION: Cutchogue, Town of Southold, Suffolk County, NY
As this is minor in nature, authorization may be by Letter
of Permission. This is in accordance with current Federal
Regulations. governing work in navigable waters of the United
States. To accomplish the coordination required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.
Pursuant to Section 307 . (c) of the Coastal Zone Management
Act of 1972 as amended. (16., U.S.C. 1465 (c) ) , the applicant has
certified that the activity complies with and will be conducted
in a manner that is .consistent with the approved state coastal
zone management program.
