MOONEY, applied to the Southold Town Trustees for a permit under the provisions. o-f the Wetland Ordinance of the Town. of Southold, application dated November 15, 1995, and, WHEREAS, said application was referred. to the Southold. Town Conservation Advisory Council for their findings and recommendations,. and WHEREAS, a Public Bearing was held by the Town Trustees with respect to said application on February 2.8, 1996, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the. health, safety and general. welfare of the. people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees approves the application of DANIEL MOONEY to move an existing house at 48Q Rabbit Lane, (from Bay side) to across the street (on. Mooney Rabbit Lane, East Marion Calendar Date: November 30, 1995 Dear Madame/Sir, You may recall that at the last meeting of the Board of Trustees I appeared in support of my application to move the house located at 480 Rabbit Lane, diagonally across Rabbit Lane, onto a lot owned by me. At that hearing I suggested to the Board that the foundation of the house would be enclosed in an earthen berm. I have since decided not to pursue an earthen berm. However, I am enclosing herewith 2 copies of a survey from Van Tuyl Surveyors which shows the decks on the current house which will be moved onto the parcel on the north side of Rabbit Lane. In addition, with respect to the application of my wife and I to move the house from 480 Rabbit Lane, please be advised that until such time as we complete the plans for a new home, that the septic system will be properly capped until such time as I obtain a building permit and commence construction of the new home at 480 Rabbit Lane. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also' understood that those who determine significance may have little or no formal knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge.in one particular area may not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet.flexible to allow introduction of information to fit a.project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides-objective data and information about'a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. ?art 2: =ocuses on identifying the range of possible impacts that may occur from a project or action. My office has not yet received this application so I am not too familiar with the specific details. However, it appears that the existing house will be removed from its foundation and relocated to an adjacent lot. The existing foundation and sanitary system will bd left in place. The NYSDEC typically allows]existing sanitary systems to be abandoned in place as long as the waste line is capped so nothing can be discharged into the system. If Mr. Mooney is planning on utilizing this system in the future, he will be held to the current development restrictions of 100 ft. setback to the tidal wetlands.
