MOONEY / 89 PERSHING AVENUE i LOCUST VALLEY, NEW YORK 11561 (h) (516) 671 -6766 (o) (516) 741-6565 September 21 , 1988 Board of Trustees Town of Southold Town Hall, 53095 Main Road P.O. Box 728 Southold, New York 11971 Re: Application of Daniel C. Mooney for the Installation of 3 Fence Posts and Split Rail Fence Gentlemen: I enclose herewith, an application for the construc- tion of a sixteen foot section of split rail fence together with the Short Environmental Assessment Form as required, a Plot Plan, a listing of the adjoining property owners and those with an easement over the right-of-way and a check in the amount of $25.000. I am requesting by this application that I be allowed to (maintain) install three fence posts on the beach on the bay side of my property. As the Board can see from the Plot Plan which I have submitted, there is an eight foot right-of-way to the northeast of my property. Originally three homes used that right-of-way. Due to development on Rabbit Lane and various transfers of property, there are now eight homes which have the use of that right-of-way. There are many days when there are 15 to 20 people who use the right-of-way for beach purposes. The 20 people cannot fit on the 8 foot right-of-way and hence , many of them spill over onto the beach in front of my property. 7 w Board of Town Trustees September 21 , 1988 Page -2- I have been advised to take some action, since if I do not restrict the use of the beach I will eventually be found with a claim of "prescriptive easement" . Accordingly, I decided to place the two sections of split rail fence as a marker. I am happy to allow anyone to use the beach who asks but I do not wish to have a permanent easement created over the property. I have numbered each of the plots of the surrounding neighbors on the plot plan and enclose a list of the names and addresses of the adjoining owners together with the additional residents on Rabbit Lane who have an easement over the subject property. I do not believe there are any other persons with easements over that right-of-way. If you have any questions with respect to the appli- cation or if you desire further information, please communicate with me. A return envelope is enclosed for your convenience . Thank you for your courtesy. Very truly yours, DANIEL C. MOONEY DCM/mt Enclosures g Town Hall, 53095 Main Road 4 (, r 7,tti ti P.O. Box 1179 Telephone (516) 765-1801 Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL To: Southold Town Trustees From: Southold Town Conservation Advisory Council Dated: November 15, 1988 The following recommendations were made by the CAC at its regular meeting held Tuesday, November 15, 1988: RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 667 of Robert G. Kassner on behalf of Nunnakoma Waters Association Inc. to dredge channel, approximately 3600 c.y. of material to be hydraulically removed and pumped to adjacent beach as nourishment. Corey Creek, Southold. Southerly end of Wampum Way. RESOLVED to recommend to the Southold Town' Trustees approval with stipulations Wetland Application No. 668 of Mattituck Inlet Marina for proposed dock and dredging. The CAC approves with the stipulation that the proper gradient is maintained to prevent the distruction of the bank and grasses. Also, due to the large number of boats and the popular use of the marina the CAC feels the Southold Town Trustees should require a pumpout facility at the marina. Mill Road, Mattituck. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 669 of Marie Nerosyan to remove and replace (in same location and configuration) 23 I.f. of existing timber bulkhead and attach to existing bulkheads to north and south. An 8' return to be constructed on north side. Replace and existing stairway and 8' x 11' fixed dock with a 4' x 20' walk. Maximum 10 c.y. of spoil to be removed from in fornt of bulkhead to 3' below MLW and used as backfill. Mesrobian Drive, Laurel. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 671 of Daniel C. Mooney to install and maintain three fence posts and 16' split rail fence. The CAC wishes to state, for the record, that it feels that this type of application is not necessary_ and the applicant should be refunded the application fee. 450 Rabbit Lane, East Marion. Page 2 RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 670 of George Anderegg, Jr. to remove and replace (in same location and configuration) 57 I.f. of existing timber bulkhead and two 4' returns. Backfill with concrete to be brought in. Note: Bulkhead to be removed is second existing bulkhead, first bulk- head will remain. 9045 Nassau Point Road, Cutchogue RESOLVED to recommend to the Southold Town Trustees disapproval with recommendations of Wetland Application No. 678 of Geoffrey L. Penny to add retaining wall around man-made boat basin and maintenance dredge. The CAC recommend disapproval of the retaining wall because no need is shown and the CAC has a policy not to recommend retaining walls on protected areas in creeks. The CAC recommends, however, the following '.. 1 . Two angled returns which are a continuation of the existing bulkhead. Returns should be angled to minimize wetland intrusion, and fill behind the returns. 2. Dredge area not be 4' to MLW. Recommend a gentle slope be established to shoreline. 3. Recommend the applicant keep a 20' to 30' natural buffer zone. Mason Drive, Cutchogue. RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 656 of Martin W. Kruse to construct 45' of 4' catwalk, 80' of 6' dock, 8' x 40' float dock with a 20' ramp and related mooring pilings. The CAC recommends approval, however, would like to note that the length of the dock exceeds the Trustees' guideline of 751.
