The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees- of written notice from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and all claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. Murphy, Jr. 153 Whitehall Blvd. Garden City, New York 11530 Re: Application No. 609 Dear Mr. Murphy: The following action was taken by the Board of Town Trustees during their regular meeting held on April 21, 1988 regarding the above application: WHEREAS, James F. Murphy, Jr. applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated December 10, 1987, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on April 21,�,_-1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that James F. Murphy, Jr. BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: Construct a 4' wide catwalk, to be constructed to the length needed to extend same, landward to bring it out of the intertidal wetlands, a 4' x 6' ramp to connect to a 5' x 20' float to be secured by six pilings to hold the float. Property is located at 735 Waterview Drive, Southold. This permit will expire two years from the date the permit is signed if work has not commenced by said date. There are two inspections required and the James F. Murphy, Jr. Page 2. Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such - _- amount as shall be fixed by the Trustees, .which said policies shall - name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency.which may also have an application pending for the'.same or similar project. Box 1179 TELEPHONE / Southold, New York 11971 (516)765-1801 �( SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL MARCH 24, 1988 The regular meeting of the Southold Town Conservation Advisory Council was held Thursday, March 24, 1988 at 4:30 P.M. at the Southold Town Hall, Main Road, Southold, New York. Present were: John Holzapfel, Chairman Ralph Condit, Vice-Chairman Heather Tetrault, Member Margaret Feeney, Member Betty Wells, Member Daniel Kujawski, Member John Tuthill, Member Linda Cooper, Secretary REPORTS Margaret Feeney reported that she had attended the ZBA meeting regarding the Cove project. At the same meeting the Kokes/Kerb property was on the agenda. Ms. Feeney reported that there was a great deal of dissent against the two projects. Discussion and decisions regarding both projects were delayed to a later date. The CAC secretary will be contacting Sophie Morris of the NYSDEC to obtain the forms needed to' receive a: rebate from the state. The CAC goes on record offering its sincerest thanks to Ralph Condit for his service as a member and vice-chairman of the CAC. DISCUSSIONS AND RECOMMENDATIONS On a motion by John Holzapfel, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees approval of Wetland Application No. 609 of James F. Murphy to install a 5' x 20' floating dock. The CAC recommends approval with the stipulation that applicant extend the catwalk upland to avoid damage to the marsh area. 765 Waterview Drive, Southold. On a motion by John Holzapfel, seconded by John Tuthill it was RESOLVED to recommend to the Southold Town Trustees that the application be TABLED until the location of the well and cesspool systen be clarified. Trustee Krupski: The permanent part will be three ft. wide. James Murphy: Five feet is what I applied for. The three foot catwalk is narrow. Trustee Smith: We have, in the past, gone with a 4 ft. catwalk? Trustee Kujawski: I 'm going to end up abstaining on this application. James Murphy: I 've gone .to Coastal Management and the Army Corps of Engineers and they said they can' t give me 5' catwalk, but we will give you 41 . Trustee Krupski: I thought the Board' s policy was 31 ? Trustee Bredemeyer: The Board' s general policy is 31 . Trustee Krupski: The concern of a wider catwalk is more coverage of the bottom and the intertidal area . The wider the structure the more the chance of killing the growth under the structure. -2- As far as the stability of the structure,- I have no problem with a 5 ft. float. Trustee Smith: We have, in the past, recommended a 3 ft. walkway, but if the applicant had a problem that we would extend it to 4 feet. This gentlemen feels that this would be .a safety problem for his children,. then I would have no objection in granting a 4' catwalk. Trustee Bednoski: No I wouldn' t either, Henry. John Holzapfel, C.A.C. : Can I ask one question? The fixed section of the structure might not extend past the marsh upland. Is that true? My impression was that it was not outside of the wetlands completely? It was another 5, 6, or 7 feet? James Murphy: That is no problem. Trustee Krupski: That is a concern of the Trustees. Can you bring it further upland to keep the activity off of the marsh? James Murphy: Yes. Trustee Kujawski: Are there any other comments, for or against this application? No response. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable.
