Hundley. . . . . . . ... . . .. as part of the consideration for the issuance of this permit does hereby release the ,said Board of Trustees and the Town of Southold from any and all damages claims for damages or suits that may arise ,or occur directly or indirectly as a result of any .operation carried on un- der and pursuant to this permit, and will at his own expense, defend any and all suits which may be brought by third parties, as a result -of any operation carried on pursuant to or in accordance with th e terms of this permit, and assume full Liability with respect thereto to the complete exclusion of said Board of Trustees and the Town of Southold. THIS PERMIT is subject to the following terms and conditions: 1. That there shall be no unreasonable interference with navigation as a result of the work herein authorized. i2. That there shall be no interference with the right of the public to pass and re- pass along that portion of the beach between low and high water mark. (, 3. That the work shall be subject to the .supervision and approval of the said Board of Trustees or its agents. 4. That if future operations of the Town of Southold require the removal and/or alteration in the location of the work herein authorized, or if, in the opinion of the Board of Trustees of the Town of Southold, such work -shall cause un- reasonable obstruction to free navigation, the said . Frank,G., ,Hundley. will be required upon due notice from the said Board of Trustees, to remove or alter the location of the work hereby authorized without expense to the Town of Southold, so as to render navigation reasonably free and unobstruct- ed. Therefore, the -'only -way in which the .-do,ck can be used- is in conjunction. with a mooring stake to one"side as shown in my original application. You' will 'note that the location. of .the' ;dock is off -to one side (not in the center). of my property and this 'was done to ,leave as much space as possible for use by other property -,owners. One is for a..dock that is ,already in existence. and ..which was erected in 1957 for the use of the property owners of Goose Lay Estates. This structure was built by the members of Goose bay Civic Assoc. , Inc. but the records of the Zssociation do not reveal_ any official application Town or approval from the To� of Southold for this structure .and this application is now being made as a ioatter of record. Goose Bay estates is 'a sub division and is recorded as such in the Suffolk County Clerk's office as MaD j`1171 - dated Nov. 13th, 1934. The other application is for a new dock which I propose to . erect in frond- of my own property for my oxm private use if yo.0 give. approval. .t lease consider_ -these applications in conjunction. with any other:: applications you may- have for boat moorings or docks on the waterfront of Goose bay Estates. it is my understanding that the deed for my property gives me ownership of 'Lots #168-171 inclusive along with the ownership of the beach to the boundary of the filed asap (4.8 ft. ) but my ownership of the 4.8 ft. °`of beach' is subject to reasonable use by any other owner of. property` i n Goose bay Esates. Icy deed specifically gives me the right 'to erect a dock provided it does not interfere with the reasonable use of other property o-wmer s. Please note that I have designated a 1oca.tion for my own dock which is near the west sideline of my property in order to provide the maximum frontage for use by other inland property owners.
