1958, between TOWN OF SOUTHOLD, in the County of Suffolk and State
of New York, by a mdjority of its duly elected Trustees and by
virtue of Chapter 615 of the Laws of the State of New York, passed
lin 1893, and acts amendatory thereof, and pursuant to a written
resolution adopted by a majority of the Board of Trustees of said
Town of Southold, at a meeting held pursuant to notice duly given
to all the members thereof$ on the 30th day of June, 1958, party
of the first part, and
CARL V. NISSEN, residing at Southold, Suffolk County'
New York, party of the second part,
WITNESSETH',' that the party of the first part has agree
to let and hereby does let to the said party of the second part,
and the said party of the second part has agreed to hire and by
these presents does hire and take of and from the Town the follow-
ing land under water- at Town Creek, at Southold, in the Town of
Southold, Suffolk County, New York, said premises being an area
30 feet square and consisting of all that tract or parcel of land
unddr water bounded northerly by existing bulkhead adjacent to
premises 'of Carl V. Nissen, a distance of 30 feet; easterly by
other lands under water of the Town of Southold', a distance of
30 feet; southerly by other lands under water of the Town of
Southold, a distance of 30 feet; and westerly by other lands under
water of the Torn of Southold, said westerly line being 1+7 feet
easterly from the cement bulkhead of Southold- Park District, it
being understood and agreed that the party of the second part may
install and maintain a dock on said premises not exceeding 20 feet ',
Iin length.
TO HAVE AND TO HOLD to the party of the second part,
his heirs and assigns, for and during the term of five years ,
commencing July 1st, 1958 and ending July 1st, 1963 , at the yearly
rental of Five Dollars per year, payable July 1st9 ;958, and
annually th-:reafter, during the full term of this lease.
At the expiration of this lease the Town agrees to
renew the same (if they feel it is for the best interests of the
Town) for an additional period of five years on such terms and
conditions as it may deem necessary and proper. And the said party
of the second part covenants with the Town that it will pay the
said rental at the time and in the manner aforesaid.
The party of the second part shall not under-let or
assign this lease or any part of the leased premises without first
securing the consent in writing of the Town Tuustees to such under
letting or assigning.
This lease is subject, however, to the public right of
navigation. On condition, however, that the party of the second
part will hold the said Trustees and the Town of Southold harmless
and free from any and all damages and claims arising under or by
virtue of this lease.
The party of the second part covenants that at the
expiration of said term he will surrender up said premises to the
party of the first part in as good condition as now, necessary
wear and damage by the elements excepted.
IN WITNESS WHEREOF, the said Town of Southold, party
of the first part, has by a vote of a majority of the Board of
Trustees of said Town, caused its corporate seal to be hereunto
affixed, and these presents to be subscribed by a majority of said
Board of Trustees, the day and year above wri n.

JOHN McNULTY, of Laurel, N.Y. ; ALVAH B. GOLDSMITH, of Southold,
N.Y, and FRANK DAWSON, of New Suffolk, N.Y. , all personally known
to sae, who, being by me duly sworn, severally said that they each
resided in the Town of Southold, County of Suffolk and State of
New York, a4d were members of the Board of Trustees of said Town
of Southold and constituted a majority of the same; that they
knew the corporate seal of said Town of Southold; that the seal
affixed to the foregoing instrument was such corporate seal; that
it was affixed thereunto by order of the Board of Trustees of said
Town of Southold and that each one signed his name thereto as a
Trustee and by like order.
