Thank you for your response to our Acknowledgement/Request for Additional Information. However, the Department of State (DOS) continues to be concerned with the following item: Within your correspondence dated August 22, 1994, you stated that due to a lack of fueling facilities in the area of the Nunnakoma Waters Association, fueling of vessels occurs on site. If so, DOS is concerned that fuel would be accidentally discharged into the waters of the designated Corey Creek Significant Habitat. How is the fuel delivered to the docked vessels? What precautions are employed during fueling of vessels at the Nunnakoma docks to prevent a spill of petroleum products? Are absorption booms readily available for deployment in the event of an accidental discharge? Is an emergency spill response team located within the vicinity of the boat basin? Please comment on this important issue. Please provide the information requested above to the Department of State within thirty days from the date of this letter. Wigwam Way Southold, NY 11971 Southold Town Trustees Southold Town Hall Southold, NY 11971 Gentlemen: I am writing this letter to present a little background concern- ing our association' s application for a permit to reconfigure our marina. In December 1992 , due to the Northeaster , our marina received extensive washout damage on its west bank which impacted our beach access road and resulted in loss of land and subsequent filling of our marina . We agreed that a retaining wall along the access road was required and design was completed and permits applied for . The Trustees granted us a permit for the work; NYSDEC made a site inspection and, as a result , cited the Associ- ation for many violations of the law as only one dock was DEC permitted. They were opposed to any retaining wall and, under the threat of a ten thousand dollar fine , we concentrated on getting our docks properly permitted . At this time we have backed away from our retaining wall . We met with an analyst at Stony Brook following our filing to permit our marina. The analyst had taken our sketch, drawn in a low water mark and advised us that each catwalk would have to be extended, some as much as 50 feet . They were advised that we already had very tight docking due to the convergence of the floats in the existing radial configuration. The analyst then relented and asked us to extend the catwalks to the low water line . While this too was questionable, the Marina members met and agreed that an accurate survey locating the existing docks was necessary in order to respond to the DEC . The survey was completed and the proposed catwalks were scaled on a tracing . As a result it was obvious that we could not fit our boats in due to the convergence . The fact that the marina is basically round 1 prohibited any adjustment that would yield enough clearance for our boats . It was then proposed by one of our members that we reconfigure the marina to allay the fears of the DEC concerning docks hitting the bottom at low tide and catwalks bridging the beach grasses . The boat owners agreed that such a reconfiguration was long overdue . Only one member has subsequently reversed his stand on the matter . The new layout was then designed and enthusiastically accepted by the DEC . A permit to reconfigure the marina was issued. It is pointed out that the reconfiguration is not an expansion. We are replacing seven floats with six finger floats . The new configu- ration reduces stress to the beach grasses, provides aesthetic improvement and precludes the need for dredging of the basin in the near future . Pending the actual reconfiguration, the DEC has allowed the in- stallation of only five docks for the balance of the season. The permitted site or facility, including relevant records, is subject to in-inspection at reasonable hours and intervals by an authorized representative of .the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL. Such represen- tative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. Permit Changes and Renewals 2. The Department reserves the right to modify, suspend or revoke this permit when: a) the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions of the ECL and pertinent regulations is found; b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d) environmental conditions, relevant technology,.or applicable law or regulation have materially changed since the permit was issued. 3. The permittee must submit,a separate written application to the Department for renewal, modification or transfer of this permit. Such application must include any forms, fees or supplemental information the Department requires. Any renewal, modification or transfer granted by the Department must be in writing. 4.
