SCTM #87-2-40.1 & 40. 2 Dear Mr. Haje, The following action was taken by the Board of Town Trustees during its regular meeting held on October , 28, 1993 regarding the-above matter: WHEREAS, En-Consultants, Inc. on behalf of NUNNAKOMA WATERS ASSOCIATION, applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application. dated April 12, 1993 and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on Thursday, 'October 28, 1993 at .which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board. has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town., NOW, THEREFORE BE IT RESOLVED that the Board of Trustees approves the application of NUNNAKOMA WATERS ASSOCIATION, to construct a timber retaining wall 170 + l.f. overall (including returns) generally at or above line of apparent high water and backfill with 170 + c.y. of clean sand to be trucked in from upland source. Wall is necessary to prevent further loss of land and protect road lying close to eroded bank which provides access to marina and beach for members of the association. Existing docks will be unusable due to loss of fill and shoaling of dockage area. Permit will expire two years, from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please take further notice that this declaration should not be considered a determination made for any other .department or agency which may also have an application pending for the same or similar project. Before filing this application, several potential alter- natives to correct the serious erosion problem were con- sidered. The decision was based upon environmental considerations, navigation, safety, cost, and durability. One of the first alternatives that was rejected was the replacement of fill and planting alone. It was felt that this alternative would simply recreate the prior condi- tion, which proved to be susceptible to damage that would occur during storms and other unusual atmostpheric events. Loss of the bluff not only serves to fill in the boat basin and endanger the road, but also created unsafe conditions for the many small children who utilize this area. Therefore, to use a "non-structural" approach once again would be foolhardy and simply a waste of money. The alternative of stone rip-rap was also considered. It is likely that such an alternative would be effective. However, it would also be an attractive nuisance and is Board of Trustees, - 2 - August 19, 1993 Town of Southold more likely to result in injuries to children than a wood retaining wall. The retaining wall that was selected and that is before your Board now is the most logical alternative. Place- ment in the location shown will have no adverse effect upon the beach in front as this area normally is not sub- ject to severe wave action. During those times when waves will occur there may, indeed, be some erosion as there would be on an unprotected shoreline. A wood re- taining wall would,provide the easiest access to and from the many boats kept in this area. In formulating your decision on our application, please keep in mind that both the bottom of the boat basin and adjacent wetlands are privately owned. There is no intent to damage the extensive wetland area that is being preserved at no cost to the Town of Southold, the Town Trustees, or any other governmental agency. We believe that the small extent of retaining wall is both reasonable and necessary and urge your prompt approval so that work can be undertaken in the coming off season. Ver rul yours, Roy L.
