2. VARIANCE. By resolution of the Board it was determined that

and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and
that the previous decisions of the Building Inspector (.) be confirmed ( ) be reversed.
After investigation and inspection, the Board finds that the
applicants request permission to construct addition with insufficient
side and rear yard setbacks, Halyoke Road, Orient, New York. The
findings of the Board are that the applicant has an extremely un-
usual hardship in that the residence is located in the far northeast
portion of an approximately 70,000 sq. ft. lot. The use of solar
panels aligned with the roof of the proposed addition require further
violation of the rear yard area.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, John C. and Doris B. Morgan,
R. D. 2, Box 143, Flanders, New Jersey be GRANTED permission
to construct addition with insufficient side and rear yard
setback, Halyoke Road, Orient, New York, as applied for,
subject to the following condition:
This lot shall not be further subdivided.

REASON FOR APPEAL
( ) A Variance to Section 280A Subsection 3

is requested for the reason that applicants are the owners of an existing one—family resi—
dence situated in the extreme northerly corner of their property. Due to the un—
usual placement of this residence on said property, applicants are unable to add. a
badly needed garage and storage area to their house without violating side yard set—
back requirements.

REASON FOR APPEAL Continued
1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARDSHIP because applicants' residence is situated on their property in such a
manner as to presently provide, only a 13 foot rear yard and a 4.0 foot side yard to
the northeast and northwest of said residence. Applicants have explored the possi-
bility of moving said residence so as to locate it more centrally on their property,
but have been informed that due to the age and type of construction of said resi-
dence that such a move would be problematic and unduly expensive. Since the afore-
mentioned proximity to the lot lines precludes construction at right angles to the
existing residence on the northeast and northwest sides, and since any similar con-
struction on the southeast or southwest side of the house would effectively block
access to and view of the frontal aspects of the residence, applicants are faced
with no alternative but to situate their needed garage and storage area at an ap-
proximate 4.5 degree angle to the west of the existing structure. In addition to
allowing utilization of an harmonious architectural style for this new area, appli-
cants' planned extention would provide an all-important southerly orientation for
the garage roof allowing an ideal placement for applicants' planned solar energy
collection panels.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because of the aforementioned unusual and
highly unfortunate placement of applicants' residence on their property. ldere it
not for this factor, and the relative impossibility of moving this house to a new
location, applicants would be able to utilize the vast open area of their property
without need for a Variance.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because applicants intend to preserve the basic architec-
tural integrity of their old residence. Applicants' planned addition, while pro-
viding for an ultimate efficient utilization of a most modern form of energy to-
gether with a badly needed garage and storage space, also provides for a design that
will complement and preserve the quaint and historic elevations of the existing
structure without screening it from the public view. Given the many constraints
within which the applicants must work, applicants' plan allows for the enlargement
and modernization of an older, historic-type home without changing the character of
the district and without substantial variation from the overall plan for the devel-
opment of the Town of Southold.

on the northwest: by Plainland Realty Corp. ; on the southwest by P. J. Meyer, Jr. ; on

4. That by such Petition,the undersigned will request the following relief: Permission to construct
an addition to the existing residence, which addition will have less than standard
side yard setback.

signed are: Article III, Section 100-31 and Bulk Schedule
6. That within five days from the date hereof,a written Petition requesting the relief specified.above will

examine the same during regular office hours.
7. That before the relief sought may be granted, a public hearing must be held on the matter by the
Board of Appeals;that a notice of such hearing must be published at least five days prior to the date of such
