Bourguignon. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE e and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that the Board is in agreement with the -reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or- unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, William G. Rafferty, 18 Farmview Drive, Dix Hills, New York, be GRANTED permission to set off lot with insufficient width and area, north side Pinetree Road, Cutchogue, New York, as applied for. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( x) A Variance to the Zoning Ordinance is requested for the reason that Form zsl (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP-because the applicant mas the owner of Lot Number 7 "Map of Section ' 1, Hickory Acres at East Cutchogue," Map Number 3325, which he purchased on January 31, 1966. .Said Lot has frontagg.:oniiLupin Drive. His mother, Helen Rafferty was the owner-.of'a vacant parcel on Pine Tree Road, .designated as Parcel 2 on the survey submitted with this application and his father, .William J. Rafferty and his mother, Helen Rafferty owned as husband and wife, _Parcel 1 on the annexed survey upon which parcel is construeted a one-story frame house. Helen Rafferty died on April 13,' ,,1977 leaving the vacant parcel-to her husband William J. Rafferty. Thereafter he died on May 11, .1977, leaving both parcel 1 with house and the variant parcel to the applicant herein. Accordingly, at this time, the applicant owns all three parcels. Accordingly, there is a technical merger of titleganecessitating this Variance Application. .As above stated, parcel 1 has a-one=story frame house and would have frontage of 100 feet on Pine Tree'Road; .Parcel 2 is a vacant parcel.which would also have 100 feet on Pine Tree Road,' .and world be in keeping with the general size and shape of the other parcels in-the neighborhood; the third parcel-is Lot Number 7 on Map of Hickory Acres, which has fronatage on Lupin Drive and is a vacant parcel. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because all of the parcels were formerly of: single and separate ownership-but due.to deaths now have merged with common ownership necessitating this Variance. To deny the Variance would result in an over,-size .parcel not in keeping wi th .the general character_of the_ other parcels withiri the 'neighborhood'. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the parcels were in single and separate owner- ship and the Variance would restore the parcels to the general size and shape of the other parcels within the neighborhood.
