SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... (E.D.S .T. ) upon application of Mr. and Mrs. Walter E. Robinson, 79 Delaware Avenue, Freeport, New York for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide prop- erty with insufficient width and area. Location of property: Lake View Terrace (Pvt. Rd. ) , East Marion, New York, bounded on the north by Lake View Terrace; east by now or formerly Huttenmoser; south by Marion Lake; west by K. Robb & E. Pohl. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties or unnecessary hardship because SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) (would not) change the character of the district because SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Innsector ( ) be confirmed ( ) be reversed. After investigation and inspection, the Board finds that the applicant requests permission to divide property with in- sufficient width and area, Lake View Terrace, East Marion, New York. The findings of the Board are that the Board is in agree- ment with the reasoning of the applicant. The Board is merely recognizing an existing situation as far as the dwellings are concerned. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Mr. and Mrs. Walter E. Robinson, 79 Delaware Avenue, Freeport, New York, be GRANTED permission to divide property with insufficient width and area, Lake View Terrace, East Marion, New York, as applied for. STRICT,APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sory HARDSHIP because i f the applicant is not granted a variance to the ORDINANCE, Code of the Town of Southold, Zoning, Chapter 100, Article III, Section 100-31, so as to be able to convey the northeasterly portion, currently improved by a private dwelling, of the subject premise19,,-and,to. retain the rest of .t3ie. subject-premises; also currently improved by a private dwelling, as more particularly depicted on the survey attached hereto and made a part hereof, practical difficulties and unnecessary HARDSHIP will result in that two houses are difficult to maintain and applicant wishes to only have one residence to maintain. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because the vast majority. of the individually .owned lots in the :immediate vicinity;-are.;eachF',improved by one private dwelling, whereas the' -subject premises are UNIQUE in that such premises are improved by two separate and distinct private dwellings originally built on two separate lots. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the sale of the northeasterly portion of the subject premises and the retention of the .remainder by your applicant will create two separate lots with a one and one-half story private dwelling upon each, thereby yielding lots with dwellings thereon similar to those in the immediate area and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT; in fact, the situation, as a practical matter, would.remain the same, only a boundary line between the two dwellings would be added..
