SPECIAL EXCEPTION. By resolution of the Board it was determined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... (E.S.T.) upon application of Edward and Kathryn Robedee, 1935 Pine Tree Road, Cutchogue, New York for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide prop- erty with insufficient width and area. Location of property: east side Pine Tree Road, Cutchogue, New York; Lot 2lA and part of Lot 22, Map of Nassau Farms, Cutchogue, New York. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) ehange the character of the d~trict because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavits attesting to its publication in the official newspapers, and disapproval from the Building Inspector. The Chairman also read statement from the .Town Clerk that notification by certified mail had been made to: John LeViness; Allen T. Schwab. Fee paid - $15. 00. THE CHAIRMAN: The blueprint which' was submitted with this application is by Van Tuyl surveyed March 20, 1973. The property is on Pine Tree Road and somewhere I have a note here that this is about 52 ,000 sq. ft. , is that correct? EDWARD ROBEDEE: No, that would be 17,000 sq. ft. THE CHAIRMAN: No, the whole property. EDWARD ROBEDEE: It's 1.59 acres. THE CHAIRMAN: 69,260 sq. ft. , that's larger than we thought it was. EDWARD ROBEDEE: It's approximately an acre and a half, plus. An acre and a half would be 66 , right? THE CHAIRMAN: Yes, it's approximately 69 ,000 sq. ft. The proposal here is to separate 17,000 sq. ft. on the southerly side of this property leaving approximately 52,000 sq. ft. The reason why, as we looked at it, as we were told by the Building- Inspector,. that this is held to 17,000 sq. ft. is you're trying to stay away from the blacktop driveway, is that correct? EDWARD ROBEDEE: Yes. There's .one other reason, too, if I may explain it. The former owners spent an awful lot of money in shrubs and stuff around the driveway that we now have to take care of. By cutting it off as we have, they will have the shrubs so we'll have the protection. THE CHAIRMAN: I don't think it makes any difference whether you have half the property or a third of it or two thirds or what. Anyone else wish.:to speak for this application? Anyone wish to speak against this application? (There was no response. ) After investigation- and inspection, the Board finds that the applicant requests permission to divide property with in- sufficient width and area, east side Pine Tree Road, Cutchogue, � New York.
