SPECIAL EXCEPTION. By resolution of the Bo~d ~ was d~ermined th~ a special exception ( ) be graded ( ) ~ ~ed p~suant to ~ticle .................... SectEn .................... Subsection .................... paragraph .................... of the Zoni~ Ordinance and ~e decision of the Building I~pector ( ) be reversed ( ) be confirmed b~ause 8:20 P.M. (E.D.S.T.) upon application of Frank and Vera Scott, West View Drive, Mattituck, New York for a variance in accord- ance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to divide property with insufficient width and area. Location'of property: Northwest side of West View Drive, Mattituck, New York, bounded on the north by Anchorage; east by Woodcliff Drive; south by West View Drive and A. Bascomb; west by Mattituck Creek. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) umique and (would) (would not) be shared by ail properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. ZONING BOARD After investigation and inspection, the Board finds that the applicants request permission to divide property with in- sufficient width and area, northwest side of West View Drive, Mattituck, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordiaance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Frank and Vera Scott, West View Drive, Mattituck, New York, be GRANTED permission to divide prop- erty with insufficient width and area, northwest side of West View Drive, Mattituck, New York, as applied for. TYPE OF APPEAL Appeal is made herewith for ( X) A VARIANCE to the Zoning Ordinance or Zoning Map ( ) A VARIANCE due to lack of access (State of New York Town Law Chap. 62 Cons. Laws Art. 16 Sec. 280A Subsection 3 4. PREVIOUS APPEAL A previous appeal 11hW (has not) been made with respect to this decision of the Building Inspector or with respect to this property. Such appeal was ( ) request for a special permit ( ) request for a variance and was made in Appeal No. ................................Dated ....?P.r il 12., 1977 ................................ REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 ( X) A Variance to the Zoning Ordinance is requested for the reason that applicant wishes.= to. divide property in accordance with survey attached hereto prepared by Otto W. Van Tuyl and. son dated July 15, 1964, creating one lot with 21, 271 square feet and one lot with 26, 567 square feet of upland and 11, 300 square feet of filled area. Form ZB1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because applicants purchased the property as two separate lots and now wish to sell the. easterly lot on the corner. The com- bined size of the two lots- is extremely large in comparison to the rest of the neighborhood. Since the house is situated on the west lot with a large yard on the creek side, the east lot is an unnec- essary adjunct to the west lot. The east lot is at a higher ele- vation than the west lot and is ideally suited for a separate build ing lot. Although the proposed division would leave 28 feet in total side yard on the west lot, this is characteristic of the neighborhood. r 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because applicants property now con- tains the largest area in the neighborhood. Most of the lots along West View Drive have a frontage of 75 feet or less and an area of well under 20, 000 square feet. The property immediately to the west has a 65 foot frontage and an area of only about 15, 000 square feet. The attached copy of the real property tax map shows the size and location of the lots in the neighborhood. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because all of the lots in the neighborhood, except applicants; are undersized, and almost every lot has a house on it. The property across the Anchorage to the north is a recrea- tional area and would not be adversely affected by the division. ;L 4 FVHk i.
