2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection the Board finds that the
applicant requests permission to construct dwelling unit in a
business building, Main Road, Laurel, New York. The findings of
the Board are that the Board is in agreement with the reasoning
of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created'is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the nieghborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, B. Shackman & Co., 85 Fifth
Avenue, New York City, New York (Gary Olsen, Esq.) be GRANTED
permission to construct dwelling unit in business building,
Main Road, Laurel, New York, as applied for, subject to the
following conditions:
The apartment to be created in the second floor of the
barn over the antique shop shall be not less than 850 sq. ft.
The abandoned residence on the easterly portion of the
property shall not be used for residential purposes unless
it is set off on a lot of 40,000 sq. ft. in area.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary HARD"u 4@g1se applicant seeks to rennovate a barn on the subject premises
(Zoned B'�T be used as an Antique Shop. The applicant also seeks to include in
the rennovation,, living quarters upstairs in the barn in order to gain full return
of its investmPnto and to be near, its place of business. Due to .the.fact that the
barn is a full/stories in height and only the lower level will be used and needed
for the business, the said barn is idealy suited for including living quarters up-
stairs. When'the applicant contracted to purchase the subject•premises, the
above contemplated rennovations were permitted, but due to a recent change in
the Southold Town Zoning Law, .this application for a Use Variance is required.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because applicant seeks to consbineza residential
use with a business use. It is to be noted, however, that a residential use would be
in additions but not exclusive of the business use. It is contemplated that the residence
will be occupied by the proprietor of the business.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the property will be used as a retail antique business
with living quarters above same in a barn to be rennovated by the applicant. The pro-
posed alterations will improve the general appearance of the neighborhood and will
be an asset to the Town of Southold.
