By resolution of the Board it was determined that (a) Strict applieallon of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or unnecessary (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (e) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. The findings of the Board are that the applicant suffers a topo- graphical hardship. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, George N. REASON FOR APPEAL ( ) A Variance to Section 280A Subsection 3 X ) A Variance to the Zoning Ordinance is requested for the reason that Form zs1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because to complete construction of the existing dwelling, an open deck is planned, however, due to the necessary placement of the house because of the steep contour of the lot, it will be necessary to reduce the corner of the open deck to maintain the required 35 ft. front yard setback. The lot is shallow, 1152ft. in dept4, and from the rear of the house to the rear lot line, only the 25 ft. required rear yard remains. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because this lot is one of two lots in this subdivision which has such a steep contour. To locate the house on the lot to the best advantage, it was necessary to place it at such an angle, I was just able to maintain the 25 ft. rear yard setback. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because this is an open deck, and only 3 ft. of the southeast corner of this proposed deck encroaches upon the minimum front yard setback.
