(E.S.T.) - Decision on, Appeal No. 2246, Charles A. Tramantano, 1850 Colden Avenue, Bronx County, New York for a special exception in accordance with the Zoning Ordinance, Article VII, Section 100-70 B (3) for permission to operate a used car sales lot. Location of property: south side Main Road, east of Skunk Lane, Cutchogue, New York, bounded on the north by Main Road (Route 25); east by Horton; south by Horton; west by $chaumann. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( that the previous decisions of the Building Inspector ( ) be confirmed ( SEE REVERSE FORM ZB4 ~O~G ) be granted ( ) be reversed. BOARD OF APPEALS ) be denied and After investigation and inspection the Board finds that the applicant requests permission to operate a used car sales lot, south side Main Road, east of Skunk Lane, Cutchogue, New York. The findings of the Board are that a used car lot, under the bulk requirements of the present Ordinance, requires a 30,000 sq. ft. lot. The applicant's lot is approximately 16,200 sq. ft. in size. The proposal is to use the premises principally as a holding lot for used cars to be driven elsewhere by drivers. The lot might occasionally be used for the sale of cars from the prem- ises and the residence might be used by the owners and/or drivers, thus involving both a residential and a business use on premises which are insufficient and undersized for either use. Of the several uses permitted in the "B-i" district, the used car business probably requires the most space and is the least desirable aesthetically, as well as contributing to the deterioration of property values. The property across the street is zoned "Residential-Agricultural." The applicant proposes a basic use which is the wholesale storage and sale of used cars. However, the applicant testified that the probable, principle use would be the storage of used cars until transferred to the appli- cant's wholesale yard. Wholesale storage is a permitted use in the "C-Light Industrial" district. The Board finds that the public convenience and welfare and justice will not be served and the legally established or permitted use of neighborhood property and adjoining use districts will be permanently or substantially injured and the spirit of the Ordi- nance will not be observed. THEREFORE IT WAS RESOLVED, Charles Tramantano, 1850 Colden Avenue, Bronx County, New York be DENIED permission to operate a used car sales lot, south side Main Road, east of Skunk Lane, Cutchogue, New York. Vote of the Board: Ayes: - Messrs: Gillispie, Hulse, Grigonis, Doyen. Also ,we do not wish to see an area such as this develope into one like those up the island where garages and used car lots take up the whole landscape. Tramantano has asked permission to have a used-car lot on property owned by Joseph Sala.nd east of what was known as Richmond ' s Store. Because of the density of traf- fic being parked at the corner store as well as Mrs. Schaumann' s place of business and Ted ' s auto Body Shop, in my opinion this would be a detri- ment to the community. I strenuously object to your granting this man permission to use this property as a used-car lot. Tramentano getting permission to have a used car lot on the Joseph Sala.nd property lo- cated Main Road , Peconic , New York, more specifi- cally located on the south side of Pain Road be- tween Horton and Schaumann. I feel this property is not only too narrow but would cause traffic problems compounding those that we already have with TedIs Auto Body Shop. Also there is an office being opened on the corner of Skunk Lane and Main Road , formerly the Richmond store. Thank you for your consideration in this matter. Yours truly, Isidore P. Although our property is the only residentially 7-oned lot for some distance on the south side of Route 25, the businesses are long established and in keeping with the residential property on the north side of the road. Ode feel that a used car lot would be most inappropriate to our area. Yours truly, lbb NASSAU POINT PROPERTY OWNERS ASSOCIATION P. ❑. Box 346 CUTCHaGUE, L. I., N. Y. 11935 February 14, 1977. Chairman, Zoning Board of Appeals FEB 16 REr,'o Town of Southold Town Office Southold, N. Y. Dear Sir: I am writing with respect to the application of Mr. Charles Tramantano for permission to operate a used- car sales lot on the Main Road just east of Skunk Lane. We Nassau Point residents treasure the residential- farmland nature of the Cutchogue-Peconic area,an import- ant part of which is the lack of concentrated commercial development along the main highway. A used-car sales lot, with its associated noise, traffic congestion and night lights would destroy the peaceful nature of the area at the head of Skunk Lane. We should like this application to be denied. Sincerely, George S. Case, President. Mr. and Mrs. John E. Gillies 165 Prospect Street Farmingdale, New York 11735 February 14 , 1977 FEB 16 RECT Zoning Board of Appeals . Town Office Main Road Southold, New York 11971 Re: Charles Tramantano, Application for Special Exception to operate 'a Used Car Lot Gentlemen: The undersigned, owners of property in Cutchogue, Town of Southold, wish to express their objection to the granting of the above captioned special exception which would permit the utilization of the premises concerned for use as a "used car lot" . Main Road is , of course, the major arterial highway traversing the North Fork and serious considera- tion should be given to the uses permitted on this thoroughfare. The area which is the subject of this application is now primarily farm land, rural in character, and even if it were to be utilized for business purposes, sound planning could be dictated as to those uses which would be consistent with the character of the community. A proliferation along Main Road of gasoline service stations, used car lots, etc. , would do nothing more than create along. this beautiful thoroughfare, a duplication of Sunrise Highway as it currently exists in Suffolk County. I am sure, this is something we wish to avoid. Thank you for giving this matter your consideration. Very truly yours , JOHN E.
