Location of property: Parcel A, map of property of J. Parker Wickham,
end of Bungalow Lane Extension, Mattituck, New York, bounded on the
north by Deep Hole Creek; east by other land of applicant; south by
Bungalow Lane Extension; west by R. C. Kopf.
2. VARIANCE. By resolution of the Board it was determined that

After investigation and inspection, the Board finds that the
applicant requests permission to set off existing building on
undersized lot and approval of access, Parcel A, map of property
of J. Parker Wickham. The findings of the Board are that the
Board is in agreement with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and the variance will not change the
character of the neighborhood, and will observe the spirit of
the Ordinance.
THEREFORE IT WAS RESOLVED, J. Parker Wickham, Airway Drive,
Mattituck, New York, be GRANTED permission to set off existing
building on undersized lot and approval of access, Parcel A,
map of property of J. Parker Wickham, end of Bungalow Lane Ex-
tension, Mattituck, New York, as applied for.

1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
scry HARDSHIP because the dwelling erected has been utilized as separate single
family dwelling for more than 50 years on the premises as indicated on,the survey
of Roderick Tan luyl,' P.C.y' dated May 21`. 1976, a copy''of which is: annexed hereto and
made a part hereof.
2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate
vicinity of this property and in this use district because surrounding premises are
improved with single family dwellings. 'The'subject premises was owned by
Cedric H. 'Wickham at the time of his death. Settlement of his estate requires:'
conveyance of the subject premises and others to individual lot owners. No
improvement or new construction is requested or proposed in connection :with
-r'nis application.
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because no new construction is proposed. The request

of the Last Will and Testament of COSMOS WICKERSHEIM, Deceased,
JOSEPH J. CAREY, residing at 21DO N.E . 38th Street, Lighthouse
Point, Florida, GEORGE L. PENNY, III, residing at (no number) New
Suffolk Avenue, Mattituck, New York and HELEN B. WUTTKE, residing
at (no number) Park Avenue, Mattituck, New York.
W I T N E S S E T H
WHEREAS , the above named parties hereto are owners of prop-
erties located east of Bungalow Road, at "Marratooka Point",
Mattituck, Town of Southold, Suffolk County, New York, and
WHEREAS, a right of way presently crosses the lands of the
-- above named property owners which said right of way was established
on a certain "Map of Marratooka Point, Mattituck, L. I. , N.Y. , C.H.
J 0 Wickham & Fred Lewis , Owners", dated the 19th day of May, 1926," r .

m and which said map was filed in the Suffolk County Clerk' s Office;
and
WHEREAS, said right of way has been abandoned and is no
longer. in use, and

U way as it is shown on said "Map of Marratooka Point" dated May 19 ,
1926, and in its place and stead have agreed to establish a new
right of way for ingress and egress and for the construction and
maintenance of utilities over the presently traveled roadway
U running across lands of the parties hereto , which said traveled
roadway is located north of the hereby abandoned right of way and
which said new right of way hereby established is more particu-
larly bounded and described on Schedule A annexed hereto.
NOW, THEREFORE, in consideration of the sum of $1. 00 and
other good and valuable consideration, each to the other in hand
paid, it is herewith agreed by and between, J. PARKER WICKHAM,
FREDERICK A. ROSS and BETTE ROSS, MARY ANNA WICKERSHEIM, as Executrix
of the Last Will and Testament of COSMOS WICKERSHEIM, Deceased,
JOSEPH J. CAREY, GEORGE L. PENNY, III, and HELEN B. WUTTKE, as
follows :
(1) That the right of way shown on the "Map of Marratooka
Point, Mattituck, L.I. , N.Y. , C.H. Wickham & Fred Lewis , Owners ,
dated the 19th day of May, 1926", is hereby abandoned.
(2) That the parties hereto do remise, release and quitclaim
forever to the fee owners thereof any interest they may have in..
the right of way shown on said "Map of Marratooka Point, Mattituck,
L. I. , N.Y. , C.H. Wickham & Fred Lewis , Owners , dated the 19th day
of May, 1926".
(3) That a new right of way is hereby established for the
purpose of ingress and egress and for the construction and main-
tenance of utilities. Said right of way is more particularly
described in Schedule A annexed hereto and made a part hereof.
