SPECIAL EXCEPTION. By resolut~n of the Board ~ was determined that a special exception ( ) be gra~ed ( ) ~ denied pursua~ to Article .................... Section .................... Subsection .................... paragra~ .................... of the ~ning Ordinance and the decis~n ~ the Building I~pector ( ) be reversed ( ) be co~irmed b~ause 8:25 P.M. Location of property: Right-of-way, east side Depot Lane, Cutchogue, New York, bounded on the north by Long Island Railroad; east by Sacred Heart Church; south by F. Kaelin; west by Depot Lane. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical difficulties hardship because SEE REVERSE or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( that the previous decisions of the Building Inspector ( SEE REVERSE FORM ZB4 be confixmed ( ) be reversed. / ~G BOARD OF APPEALS ) be denied end After investigation and inspection, the Board finds that the applicant requests approval of access, east side Depot Lane, Cutchogue, New York. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, John G. Zaveski, South Harbor Road, Southold, New York, be GRANTED approval of access, east side Depot Lane, Cutchogue, New York, as applied for, subject to the following condition on the rear lot: Under present Zoning regulations, the applicant may use this lot for grading and storing his own potatoes but he may not use this for grading the potatoes of other farmers. REASON FOR APPEAL (X ) A Variance to Section 280A Subsection 3 ( ) A Variance to the Zoning Ordinance ( ) is requested for the reason that . access to Depot Lane is required in order to divide the property in accordance with the attached survey by R.. Van Tuyl, P.C., dated April 14, 1977, redated May 6, 1977. Form ZB1 (Continue on other side) REASON FOR APPEAL Continued 1. STRICT APPLICATION OF THE.ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because the easterly lot has no frontage on any existing or mapped highway, except for the proposed 25 foot strip along the railroad. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because all the other lots in the area have access to Depot Lane. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the access mould be along the railroad and would not affect any other parcel. The two lots have sufficient area and width under the zoning ordinance. STATE OF NEW YORK ) ss ....................... .... r............ COUNTY OF SUFFoLK ) Sig a re John G.
